MERIDEN, Connecticut (Reuters) - A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 26 children and adults dead two weeks ago.
The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.
"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.
Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.
"We all know its going to happen again," Pinsky said on Friday. "Society has to take action."

Might be a good thing if local school boards can be made responsible for security. If your paying off lawsuits it would be harder to give your brother-in-law a maintenance contract or your daughter that full time admin job. Hell, you could give another brother-in-law the security job and continue to give teaching jobs to the kids of supporters.
That's one reason lawyers try to pack juries with morons like the OJ jurors, people who couldn't spell "DNA" if you spotted them the 'D' the 'N' and the 'A'.

My perspective on this is that if the State or Feds want to leave a school defenseless in direct contradiction to the 2nd amendment they should be held liable. Those who restrict us from defending ourselves should be held liable for not protecting us. The Constitution specifically states that the Fed is to provide for the common defense and if they take away our individual abilities they defend ourselves they should be held accountable for not doing so.
And every other surviving child should get the same amount... say about 200 kids in the school...
$100 million x 200... plus $200 million x 26... that's about $25.2 billion total.
The Connecticut state budget for education is about $11 billion. So we need to shut down every school in the state for over 2 years because somehow the taxpayers must be punished for the acts of Adam Lanza.
Well Mr Pinsky please do tell us when and where the next “forseeable” tragic event will occur .

i used to know Irv. Compared to most attorneys, he’s a normal human being. I guess his client will get her day in court.

This chap might be a stout Second Amendment advocate for all we know. Lawsuits like this almost never win ultimate awards nearly as big as they ask. Courts whittle them down to nubs.
Oops! It was the largest elementary school in the state. 600+ students. So make that total $65.2 billion in jury awards. Let’s shut down their schools for the entire state of 6 years then.

Yes, but them being liable translates to the state being liable (since they were acting on behalf of the state) and hence the taxpayers foot the bill while the party responsible for the decision walks away scott free. Given civil service protections, doubt they would even lose their job.
How does a lawsuit stop terrorist attacks?
And what’s going to prevent such claims in the future, not only in Connecticut, but everywhere else it happens from now on?
Not outlawing guns, I’ll tell you that. Nuts will always be able to get them. Only hiring security (as they do in Israel) and/or allowing [some] teachers to pack has a prayer of diminishing the number and severity of these outrages.
This is a public school.
We already know that many private schools routinely provide armed security guards for the protection of all their students.
Why? Because they acknowledge a potential threat to the students safety exists.
Are any of the public high schools and/or public middle schools in that area staffed with armed guards?
I have spent a good deal of time in Meriden, CT.
When Connecticut needs an enema, Meriden is where they stick the tube.

The thing is, that they will go after the firearms manufactures.
Even if Bushmaster, Glock et al are found only one percent responsible, if the suit is for 100 million dollars.....
Thinking like a leftist lawyer, I would go after the companies that made the weapons and the dealers that sold them, even if one out of a hundred lawsuits won, and even if only for a few percent liability, one could put a lot of people out of business.

The courts, including the Supreme Court, have repeatedly held that Law Enforcement is unable to prevent every murder or mass killing, nor do they have the obligation to do so!

This wasn’t even a kid in the room where the killing took place, there it’s a kid from that room who it’s alive, I would say that that kid it’s far worse off by watching all of her friends die.
That may well be. And in the short term there will be negatives for the state. However, its time we force the issue of the risk to them of taking away our second amendment rights. I believe they are truly liable for the deaths of those children and adults. It the attitude had been different and there were teachers, administrators, or others in the school that were armed and the public was well aware of that we all know the outcome would have been different. Sure its our taxes but they already have that and if we take more of that away from them and continue to force the issue maybe we can get across to them that shall not be infringed was there for a reason. I would hope that the general public would begin to realize that the state/fed is irresponsible by not allowing defense.

Nice try. However they are responsible when they take our rights away as per the 2nd amendment they have made us vulnerable. They also use the flawed reasoning that the police are there to protect and serve so we shouldnt need guns.
