Georgetown University constitutional law professor Louis Michael Seidman has just about had it with the focus of his 40 years of academic study. As he writes in the New York Times on Monday, it is the Constitution itself which has allowed for the series of legislative follies that finally resulted in the fiscal cliff. Seidman says that it is time for Americans to realize what lawmakers have known since the constitutions inception it is okay to ignore it.
As the nation teeters at the edge of fiscal chaos, observers are reaching the conclusion that the American system of government is broken. But almost no one blames the culprit: our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downrght evil provisions, Seidman writes.
Our obsession with the Constitution has saddled us with a dysfunctional political system, kept us from debating the merits of divisive issues and inflamed our public discourse. Instead of arguing about what is to be done, we argue about what James Madison might have wanted done 225 years ago.
He goes on to detail the number of American politicians who have used every opportunity to sideline the Constitution; from John Adams to Abraham Lincoln to Franklin Delano Roosevelt.

Sounds like a plan to me. The Government should shut down the New York Times.
What are these “evil” provisions in the constitution according to this professor?
The problems in America are directly proportional to our distance from our faith, and it’s priory in our lives.
Our Constitution is fine.
AWE - TOO BAD. TOUGH, TOUGH. I DON’T FEEL YOUR PAIN.
Go to Cuba and see what it gets you.
Or better yet invited in the militia to burn them out ~
In other words, pretty much the same view Obama was expressing on Chicago Public Radio a decade ago.
The Constitution is our country and our country is the Constitution.

What the hell is wrong with these Jews? Are they begging for a return to the Holocaust?
Look, he’s a Jew who threw out the Torah years ago. So why not toss out the Constitution?
The Torah IS Judaism. The Constitution IS the United States of America.
Overspending has nothing to do with the Constitution. It’s simple math.
The Constitution is fine—but there ARE evil people—take a look in the mirror, Seidman.
This traitorous a-hole should be disbarred and run out of town on a rail. Interesting thing, these leftist are really to show their true colors and what they think of this country and the people who want freedom over an “efficient” government which can do whatever it wants.
This guy argues against himself: it’s adherence to the Constitution that causes all the disfunction, yet he sites politicians who ignore and sideline the Constitution.
As Obama has said (I paraphrase), the free market system "doesn't work now...never has." (source)
Pride has consumed this man to an extent where he no longer makes sense.
One thing about liberals, they love to think they are smarter than others.
It’s the Constitution that allows u to spout such spittle criticizing your government and still keep your job, you over privileged idealistic attention whore.
“Seidman says that it is time for Americans to realize what lawmakers have known since the constitutions inception it is okay to ignore it.
Well, professor, you are wrong, even after all these years of study and teaching. The problem is not the Constitution, or even simply ignoring it.
The very REAL problem is that that American sheeple have let it happen. They’ve allowed elected officials at all levels to hoodwink, scam, and game them with NO significant repercussions. In fact, in many cases, these same carpet baggers are re-elected to office over and over again.
The solution may be some manner of major overhaul of voting...something drastic. Perhaps, allowing to vote only those people of age who are NOT drawing some form of government (read that “taxpayer”) subsidy for their existence, with the exception of Social Security. Another would be proportional allocation of electoral college votes based on the popular vote in each congressional district.
Traitor...exactly. Find out if the man is joking or serious. If serious, fire up the firing squad. The Founders are dead, but long live the Founders!
Foolish men like this are dead even while they live.
I don’t get that, either. Throughout history it seems, many Jews have been promoters of socialism and communism, even though they are the first ones to be targeted when the socialists attain power. Curiouser and curiouser, as Alice said.
I'm going to hazard a wild guess here, but I'll bet the prof has a real problem with the Bill of Rights. I will also bet he's a real fan of totalitarian government that doesn't have such niceties because they get in the way of enlighten people just like him. You know who they are — elitist liberals, socialists, Marxists, and other bed wetters.
Let me guess, the “evil provisions” of the constitution include the following:
2nd Amendment
Separation of Powers
First Amendment with regard to private worship and campaign donations
Restrictions on government seizures of property.
Good point.
What obsession? All three branches simply ignore the Constitution whenever it gets in their way.
The professor is correct about one thing - politicians have been trying to ignore the Constitution since its inception. It’s sad, but the American people have supported them if they think there is some gain for them.
“Most people want security in this world, not liberty.” ~ H.L. Mencken
To those of no faith in the fidelity of the words which are our bond, of course the US Constitution seems to be “dysfunctional”.
But the question remains, with what should it be replaced?
No likely drafts have ever been composed that so distinctly support the rights endowed by our Creator - “Life, Liberty and the Pursuit of Happiness” as enumerated in the Declaration of Independence.
But for some, life, liberty and pursuit of happiness are not among the paramount goals, virtues or rights of mankind, and certainly not if they are endowed by some supernatural diety. “Everybody knows” there is no such thing as God, we are here only by accident, and by accident, we, too, shall pass away.
Leaving, of course, a pristine Earth without the taint of humanity. But who would be there to record the fact?
He sounds like a complete moron
And the defining character of evil men is...LAWLESSNESS.
Wherever you find a “Progressive” you’ll find a reprobate.
Cicero warned the people, Paul the Apostle warned the people and the Founders warned the people to turn away from such men.
Let us heed their wise counsel.
What we allow the government to do rather than the government telling us what we can do. What part of “We The People” doesn’t this moron get?
The balance of powers, for starters. He clearly wants a more powerful presidency, so long as that president is a Democrat, of course.
I’m also sure he has great problems with the Bill Of Rights.
This is a Georgetown University law professor's opinion.
So, he is saying that we are slaves to the constitution which describes a government "of the people, by the people, for the people".
They have their messiah in place. If they can continue to have America ignore the constitution, the destruction of the USA will be complete.
Looks like they have a pretty good shot.
If these communists hate this country so much, why don’t they just leave? I’ll even help them pack.
You can take the Constitution from my cold dead hands!
What is this guys background. Where was he raised, who was his parents? Who was his mentors growing up.
Hey, Louie! It's not ok to ignore the constitution.
It is time for lawmakers to realize what Americans have always known, strict adherence to the constitution is one of the things that will save this country. The other, put God back in the public square and apologize to HIM for so flippantly disregarding HIS many blessings.
This demented excuse for a man is in the same class with the patient who refuses to take even one dose of his prescription and then blames the physician for not prescribing something else. In other words how can someone know the constitution is flawed when it has hardly ever been followed? Ignore all the garbage flowing from the mouths of “experts” and read the document and it will easily be seen that it is ignored almost in its entirety and has been for most of the life of the republic. Almost any abomination imaginable has been declared “constitutional” at one time or another by some judge or judges with the most egregious examples being recent USSC decisions. A law degree is not necessary to UNDERSTAND the constitution at all, it is only necessary for those tasked with writing absurd decisions in legal terms intended to mask the fact that the decision is upside down and backwards from the real intent of the founders. If a new constitution were to be written by such as this man it would be ten thousand pages and all of it would reduce to one sentence. Do as you damned well please and the citizens can go to blazes.
I’ve about had it with professors - particularly those that teach ‘law’.
I take it the Constitution is evil in its lack of being applied.
Well, 40 years in academia is proof that he's a total non-hacker. Peope like him are incapable of success in the real world so they hide out on college campuses.
“Academics” are often the most narrow-minded and reactionary people I meet.
Snide remarks about the invisible and permanent powers-that-be (Republicans) trying to take down minorities...... is a sentiment some minorities bandy about when they try to justify (what they deem) is their loser status.....
They now have the para-military Ohaha enforcers to act on their gripes.

THIS KIND OF PERVERSE CORRUPT THINKING IS REMINSCENT OF THE POST-CIVIL WAR ERA----Carpetbaggers---Northern invaders into the South ----were prominent in politics until 1875, but nearly all left under pressure from the Red Shirts and White Liners -----white paramilitary organizations, then-described as "the military arm of the Democratic Party", working openly to violently overthrow Republican rule, using intimidation and assassination to turn Republicans out of office and suppress freedmen's (former slaves) voting.
The Republican sheriff of Yazoo, Mississippi, received a brief flurry of national attention when insurgent white Democrats took over the county government and forced him to flee. (WIKI)

FREEPER ACTION----In 1875, Hiram Revels, a Mississippi Republican--and the first African-American US Senator-- wrote to then-Pres Ulysses S. Grant denouncing Northern invaders into the post-Civil War south for manipulating the Black vote for personal benefit, and for keeping alive wartime hatreds. (WIKI)
We need to get someone with integrity----like Cong Allen West (not reelected)----- to write letters to his colleagues, and to the media.
Cong West needs to do the following:
(1) decry the agitation and intimidation tactics being used by these groups,
(2) expose using hatemongering for personal gain,
(3) emphasize the illegalities WRT threatening members of the US Congress,
(4) precpitate investigations into fraud and intimidation upon our electoral/legislative system by these hate-mongering groups, and,
(5) determine the scope and dimension of subversion these activities are visiting on US ntl security.
that’s what we always said in law school: the A students teach, forgot what the B students did, and the C students practice law
Ohaha is going to need to install the Mexican Army in the WH to organize camo-clad street patrols wearing shoulder holsters to suppress “the resistance.”
oh you ought to see the way academics rip and tear at each other, trying to prove which of them is “smarter”, it is feral
My father-in-law and I had a Christmas visit discussion a few years. He is a liberal ass. Voted for Obama...you are getting the picture. I try, for my wifes sake, to be amicable. But I have learned not to discuss politics with the bastard. Then somehow he started talking about conservatives...”worship THAT OLD RAG”, “THAT OLD RAG”. I said to him, ‘Excuse me?” He repeated his venom, and I could not take it any more. I essentially lit into his sorry ass and told him, “That Old Rag is the only thing that keeps the government from tearing off the doors to your house and taking any and all you have.” “I informed him he was idiot.” I did not ask him to pass the gibblet gravey to me on Christmas dinner.
Sounds to me like a stinging rebuke to the progressives. This guy realizes that not following the constitution leads to chaos. He probably does not share my views! But think back to FDR and the way he changed the way government views the constitution.
Thomas Jefferson was a liberal. This prof is Goebbels.
We need the Constitution to protect us from men like Seidman. It’s a pity that a single drop of blood be shed to defend this pant load.
