Sheriffs called out to fight the law (resisting gun confiscation)

A high-profile former sheriff who once sued the U.S. government over its gun regulations – and won – says it’s the local sheriff who will have to defend Americans when and if the feds start banning and confiscating guns.

Richard Mack, a former sheriff in Graham County, Ariz., joined with then-Ravalli County Sheriff Jay Printz in a lawsuit against Washington when Bill Clinton demanded sheriffs enforce provisions of the Brady Bill gun-control law.

He won. And since then he’s been at the front of a movement that highlights the responsibility of local sheriffs.

Now, as Washington gears up to consider imperious plans to limit guns, require fingerprinting and registration, impose additional taxes and fees, ban particular features or functions outright, and even confiscate weapons of self-defense, Mack has told WND that there’s hope remaining in local law enforcement.

It’s not complicated, he said.

“Gun control is illegal, and it’s against the Constitution,” he said. “What people don’t realize is that the Second Amendment was designed to protect us from the power of the federal government.”

He said he would expect sheriffs across the country to defend the rights of ordinary Americans.

“I hope and pray America’s sheriffs won’t allow any more gun control,” Mack said. “The sheriffs need to be united in letting the federal government know that we’re not going to allow it

The local Sheriffs might be our last chance at legal resistance.

After what happened in congress yesterday we can no longer expect that the republicrats will do the right thing.

Some sheriffs will oppose it, but others will probably help enforce it. I suspect mine will try to help enforce it, unfortunately.

I was talking to my next door neighbor and friend since high school who also happens to be a Deputy Sheriff. I jokingly asked him if he was coming to pick up my “assault weapons” when the feds ban them. He laughed and said, “Let them pass all the laws they want, I'm not registering or turning in mine, so why would I expect you to do any different?”. We talked about it a little more and he said the didn't know of one county or state law enforcement officer who would enforce such a ban for fear of the backlash. Like he pointed out, they live in the communities they serve and pissing off large numbers of otherwise law abiding citizens isn't very smart...or healthy.

Yes, but would it be worth it if your afraid to sit on your front porch because one of those neighbors or their family members might decide to "mistake you for a deer" or your kid is getting beat up a school because daddy is a "gun grabber" or your wife is getting her tires slashed every time she goes to Wal-Mart?

So if your local sheriff is an elected or appointed RAT he needs to be high on the target list when the SHTF. Because he surely won’t be of any help.

The fastest way a Sheriff can prevent gun confiscation is via invoking the (state authorized) “posse comitatus”, (literally a ‘posse’, not the federal Posse Comitatus Act.) As an “able bodied adult person”, technically ‘conscripted’ by the Sheriff, they would be immune to efforts at gun confiscation, unless the feds tried to confiscate guns from all LEOs as well.

Though rarely used, the posse comitatus continues to be a modern legal institution. In June 1977, for example, the Aspen, Colorado, sheriff called out the posse comitatus — ordinary citizens with their own weapons — to hunt for escaped mass murderer Theodore (”Ted”) Bundy.

Many states have modern posse comitatus statutes; one typical example is the Kentucky statute enacted in 1962 that gives any sheriff the power to “command and take with him the power of the county or a part thereof, to aid him in the execution of the duties of his office”

Unfortunately, I haven’t been able to find a list of which states have posse comitatus laws, and more importantly, which do not.

But the bottom line is that, if authorized by state law, a Sheriff could just announced ‘posse comitatus’ in his county, and about the only way the feds could do anything would be for the POTUS to order the US Army to invade that county, like Eisenhower did to Little Rock, against the Arkansas National Guard put in place by their governor.

But I truly doubt the US Army would be too keen to the idea of invading the US to confiscate the guns of its citizens.

If he is on board, he is the first one to contact when the SHTF.

The Office of the Sheriff has existed for over one thousand (1000) years and is the oldest law enforcement position in the United States. The word Sheriff is derived from the Shire-reeve, who was the most powerful English law authority figure, even before 1000 A.D.

The Shire-reeve, in contrast to a reeve (in charge of mere tenths), was responsible for both the order of the land within his banded group of a hundred families (shire) and the call of the "hue and cry".

The hue and cry made every citizen in earshot of the sheriff’s call lawfully obligated to join in a posse-commitatas, or group, which banded to catch criminals

The Magna Carta was written and signed by King John in 1215 A.D., nearly 800 years ago. The sheriffs had already existed and were known under this sir title. Sheriffs had been recognized as principle participants in the drama of government, seated just under the crown’s barons in hierarchy. Their duties and responsibilities mostly carried over as America was established.

The first such transition of the English Sheriff to American soil was in Virginia in 1634. Sheriff’s were still appointed by the King and was an extension of royal authority and representative of the King. There is a record of a sheriff being elected by popular vote as early as 1651, but this was highly irregular for the rules of the era.
