Pennsylvania's Governor Is Suing The NCAA Over Its Sanctions Against Penn State

HARRISBURG, Pa. (AP) — Gov. Tom Corbett scheduled a news conference for Wednesday to announce the filing of a federal lawsuit against the NCAA over stiff sanctions imposed against Penn State in the aftermath of the Jerry Sandusky child sex abuse scandal.

A person associated with the university and knowledgeable about the matter told The Associated Press that it is an antitrust action.

In announcing the news conference, Corbett, a Republican, did not indicate whether his office coordinated its legal strategy with state Attorney General-elect Kathleen Kane, who is scheduled to be sworn in Jan. 15.

Kane, a Democrat, ran on a vow to investigate why it took state prosecutors nearly three years to charge Sandusky, an assistant under legendary football coach Joe Paterno. Corbett was the attorney general when that office took over the case in early 2009 and until he became governor in January 2011.

State and congressional lawmakers from Pennsylvania have objected to using the Penn State fine to finance activities in other states. Penn State has already made the first $12 million payment, and an NCAA task force is deciding how it should be spent.

The NCAA, which declined to comment Tuesday on the planned lawsuit, has said at least a quarter of the money would be spent in Pennsylvania.

Republican U.S. Rep. Charlie Dent called that an "unacceptable and unsatisfactory" response by the NCAA to a request from the state's U.S. House delegation that the whole $60 million be distributed to causes within the state.

Last week, state Sen. Jake Corman, a Republican whose district includes Penn State's main campus, said he plans to seek court action barring any of the first $12 million from being released to groups outside the state.

So why is Corbett, who has been a generally respectable Republican Governor, chiming in with the Paterno Kool-Aid Drinkers in Happy Valley?

Pure politics IMHO. The state is trending back into the blue, and Corbett must stand for re-election in 2014. Ingratiating himself to the Blue-and-White-uber-alles crowd
is simply good politics (even if it is crappy morality).

This is why the death penalty would have been cleaner - no football at Penn State for a decade. Done. No fines.

Having a state school pay fines, when they should have specified 1) that the funds come from the school’s endowment and 2) the funds be spent ANYWHERE but PA.

Why should the locals benefit financially from the rape of children?

NCAA’s response should be, “Hey, not a problem. Penn State football will be back in 2023 instead and you can keep the change.”

The University signed a contract with the NCAA. Don’t see what the governor has to say about it. A contract is a contract.

The reason why the NCAA didn't give the death penalty--and will never give it again, at least to a major school--is that there is a substantial risk that schools will simply leave the NCAA.

The NCAA's worst nightmare is if a group of 20 or 25 football powerhouse schools leave the NCAA. As it stands right now, the non-football sports provide enough reasons for mega-football schools to stay in the NCAA. But if the mega-football schools begin thinking that the NCAA gets too big for its britches, like, for example, shutting down the sole biggest revenue providing sport at a mega-football school, then other schools will start to think much more carefully about leaving the NCAA.

And then what for the NCAA?

The way ESPN portrayed Penn State as the victim in all this made me sick. They broadcast every Penn State game early in the season and pictured them in a sympathetic light in their season highlights on the last Game Day show.

In my opinion, Penn State should have been forced to end their football program forever. A grown man traveling and showering with boys? Yeah, right! There had to be coaches, players, students, staff, trainers, and others who knew, or at least suspected, what Sandusky was doing but chose to look the other way. Joe Paterno and his son, in particular, were despicable.

It appears that Corbett and the PA politicians are not questioning the contract specifying a $60 million payment from Penn State. They just want that money given to them so that they can spend it on their pet projects within the state.

It is supposed to go for child abuse prevention programs, so Corbett and the PA politicians will have to show that there is a lot of child abuse going on in PA in order to get this money.

This is the tip of the iceberg. The Paterno family lawsuit against the ncaa (coming) will make this look like child’s play. You’re seeing the beginning of the end of the ncaa.

The problem with the way it was handled was they ended up punishing the students who go there and had no idea all this horrible crap was even happening.

I’d say, transfer all students to other colleges paid with the funds of all the fired Staff and Administrators. And then shut down the school for a good decade or two..

Actually this may be more like Corbett trying to muddy the waters and head off an investigation into his handling of the Sandusky affair which languished for 3 years under his Attorney Generalship during which he was accepting money from Sandusky’s Second Mile Charity.

You seem to be in favor of the collective mass punishment of those having no connection to the illicit sex, including the taxpayers. Why not focus on those who actually committed crimes?
