Neither. Failure to follow a law is not necessarily a crime and often is not. This is not a crime. It may be maddening, but there is no criminal violation here.

RE: Failure to follow a law is not necessarily a crime and often is not.

So, if an ordinary Joe fails to purchase insurance under Obamacare, is it a felony or a misdemeanor or neither?

Agreed ,.. after all , who would prosecute ?
Holder ? .. Hah , ha , ha ...

If the requirement was stated in the Constitution , he could be cited as a violation of his oath to support and maintain the Constitution.
Subject to ‘recall’ .. ?
Who would prosecute ? - the House of Representatives
Then bring it to the Democratic Senate .. it would at least put them on notice
And override the ‘Dingey Harry’ one man fillibuster !
