when upper levels of government ignore the constitution it is the duty of lesser magistrates to protect and enforce it. the whole point of the constitution is to limit government as to what it can do. when government ignores it it says we have no limits, so state governments, many who have much of the us constituion in their own state constituions, step in and say, not so fast, there.
