NY Democrat pleads with Republican not to share document proposing confiscation of guns
The commentator ^ | 1/20/2013 | The commentator

The State of New York this week passed some of the strictest gun control laws in the United States, effectively outlawing 'assault weapons' and limiting the size of magazines.

But if Republican Assemblyman Steve McLaughlin is to be believed, the New York State Democrats would have gone further if they could have. Much, much further.

In a video posted to his Facebook page, McLaughlin has shared the information of a 'secret' Democrat proposal not simply to make the purchasing of the crudely monikered 'assault weapons' illegal in New York, but also to engage in a mass confiscation programme, removing Americans' weapons from their possession.

McLaughlin writes:

"Here it is. This is the video where I was asked to keep the Democrat proposals for the NY SAFE Act away from the public. This list was given to me by a colleague and it is not confidential.

This bill was an attack on the 2nd amendment and the Democrats clearly wanted to dismantle the work of the Founding Fathers. None of these amendments were included in the final bill thanks to us fighting back. I will not stand silent while these unpatriotic proposals are pathetically thrown at us a 11 o’clock at night":

Would be nice if they had fought harder.

The reason for the 2nd Amendment is to provide protection against a government that passes laws such as those outlined above!

Where were the Repubs when the socalled “Safe Act” was passed in the NY Senate?

Oh that's right, they voted for it.

Yeah, the Repubs could have prevented this atrocity, but now they say “we stopped the Dems from taking all your rights away”. They should have stopped what already has occurred!!!!

The Administration is lying!

NBC News Special Report is now reporting that NO assault rifle was used in the Newtown school shooting! The AR15 rifle WAS left in the car and not used. So this assault on the people's Constitutionally guaranteed rights to the use of firearms is based on BS (capital B, capital S) put out by the administration.

Stand by folks, because there is more information soon to come forth about this (so called) random school shooting!!!

tired&retired :

Yes , that is exactly the list as I have it too
This bill was no happenstance !
It was presented at 11:00PM , and NO ONE had a chance to read the bill !!
This list didn’t just suddenly spring up out of nowhere !
It was planned by those who would disarm us , but not necessarily anticipated ..
It is a plan for future challenges which the libturd base intends to implement nationwide

Fortunately , these proposals didn’t all pass , .. this year , maybe next year ... (?)
The intent is clear ~ DISARM ALL THE CITIZENS
Make the laws so convoluted that no one who owns a firearm can comply (no one commercially makes a 5 or 7 round magazine)
Make every gun owner a CRIMINAL !!
Reread that last statement again ..
Make EVERY GUN OWNER A CRIMINAL !!

First - It applies to New York ..
Then , .. comming to your state !!
This is their agenda .. prepare !!

:::::::::::

Of course they are lying. That is all they do. And the FOOLS of the Congress let them get away with it. This opportunistic political gun-confiscation effort has nothing to do with the recent incident of a nutcase going wild. They could care less about THAT. Just a convenient “crisis”.

It is all about disarming the LAW-ABIDING American citizen, and TRASHING THE CONSTITUTION. Just another step in the radical, anti-American agenda of this administration.

“Congress has no power to disarm the Militia. Their swords, and every other terrible implement of the soldier, are the birth-right of an American. The unlimited power of the sword is not in the hands of either the Federal or State governments, but, where I trust in God it will ever remain, in the hands of the people.”

– Tenche Coxe, letter to James Madison during adoption of the Bill of Rights in the United States Congress (1789)

“A militia when properly formed are in fact the people themselves...and include all men capable of bearing arms. The Constitution ought to secure a genuine militia and guard against a select militia, by providing that the militia shall always be kept well organized, armed, and disciplined, and include...all men capable of bearing arms. The mind that aims at a select militia, must be influenced by a truly anti-republican principle.” “To preserve liberty, it is essential that the whole body of the people always possess arms and be taught alike, especially when young, how to use them.” “... of the liberty of conscience in matters of religious faith, of speech and of the press; of the trial by jury of the vicinage in civil and criminal cases; of the benefit of the writ of habeas corpus; of the right to keep and bear arms.... If these rights are well defined, and secured against encroachment, it is impossible that government should ever degenerate into tyranny.”

– Richard Henry Lee, Letters From The Federal Farmer (1788)

Some interesting tidbits:
1. NY State Constitution does NOT have a 2nd Amendment. There is no state law guaranteeing the freedom to bear arms.
2. Federal law would trump state law, IIRC.
3. Article I, Section 10, Clause 1 of US Constitution says “No state may... pass any Bill of Attainder, ex post facto Law,”
4. A bill of attainder NOT punishable by death is caled a bill of pains and penalties. Same prohibition.
5. Bill of attainder: The loss of all civil rights by a person sentenced for a serious crime. In the context of the Constitution, a Bill of Attainder is meant to mean a bill that has a negative effect on a single person or group (for example, a fine or term of imprisonment).
6. SCOTUS extant law is Calder v. Bull (1798) “states are prohibited from bills of attainder.”
7. When do the lawsuits start?

NEW YORK:

Conditioned its ratification of the new U.S. Constitution on adoption of the following: “That the people have a right to keep and bear arms; that a well regulated militia, including the body of the people capable of bearing arms, is the proper, natural, and safe defense of a free state.”

The New York Constitution of 1777 contained no Bill of Rights, but its framers insisted that the federal Constitution include such provisions. In addition, the members of the constitutional convention in New York “were obliged to go armed, so as to protect themselves from stray marauding parties ....”.

No reference in the present Constitution.

There’s some discussion on the NY page. There is a lawsuit already started. Demonstrations in Buffalo and Albany yesterday.

Problem seems to me that the other side are organized and they flood the inboxes and phone lines. We did too but they must have done us one better. There was even a tiny pro-gun-control protest in my neighborhood yesterday.

Eighteen Republicans voted against this in the State Senate, I believe all from upstate. Upstate is different, but there aren’t enough of them anymore.

Does anyone think the criminals that are armed today are going to disarm?

Anyone think the black panthers are going to disarm?

Anyone think the thugs in your major urban cities - black thugs - the ones that just look at you with a look they want you dead - are going to disarm?

Seriously. They want it open season on whites in particular (Eric the Racist Holder) and anyone who isn’t a criminal, in general.

the government attacking our 2nd amendment rights is no different than them attacking our 1st.

Imagine if the list looked like this:

The full list of proposals can be read below:

1. Confiscation of all bullhorns, microphones, newspapers, books, magazines and ability to post news on the Internet.

2. Limiting all speech to 10 words or less.

3. Statewide database for ALL people seeking a permit to speak freely.

4. Continue to free speech permit holder’s information to be replaced to the public

5. Label all speech consisting of more than 5 sentences as as “assault weapons”

6. Limit the number of sentences anyone can say to 5 and confiscation and forfeiture of all banned means of disseminating the news.

7. Limit possession to no more magazines, books, or newspapers.

8. Limit purchase of news to one type per person per month

9. Require re-licensing of all free speech permit owners

10. Require renewal of all free speech permits every five years

11. State issued free speech permits

12. Micro-stamping of all forms of news and printed speech in New York State

13. Require licensing of all printers, copy shops, and web hosting services

14. Mandatory locking of all news related material at home
