President Obama to push gun control proposals at Minnesota stop

WASHINGTON (AP) -- The fate of his gun proposals on Capitol Hill uncertain, President Barack Obama is seeking to rally support from the public and law enforcement community for his calls to ban assault weapons and install universal background checks for gun buyers.
Obama will pitch his proposals to stem gun violence Monday in Minnesota, a Democratic-leaning state where officials have been studying ways to reduce gun-related attacks and accidents for several years. His visit to the Minneapolis Police Department's Special Operations Center will mark the first time Obama has campaigned on his controversial proposals outside of Washington.

David Axelrod Attributes Chicago Murder Rate to Lax Gun-Control Laws in Surrounding Areas

As President Obama prepares to stump for gun-control legislation in Minneapolis today, David Axelrod offered him a helping hand on morning television.
In doing so, Axelrod attributed the murder rate in the city of Chicago, which is subject to some of the most stringent gun-control regulations in the nation, to the lack of such laws in surrounding areas. We live in Chicago, and one of the reasons we have such a huge problem in this city is that all around us are areas with weak laws and with very lax background checks and a lot of illegal guns flow into this city, Axelrod told MSNBCs Joe Scarborough. Every law enforcement official will tell you that.

New Mexico Family Gun Shop Owners Get New Trial

Last summer, I told you about the Reese family in Deming, New Mexico. Rick and Terri Reese, along with their two sons Ryin and Remington ran a gun shop. They kept meticulous records and ran their successful business according to the letter of the law. Then suddenly, they found themselves charged with violating federal gun trafficking laws. They were arrested and the feds seized the gun shop along with its $2 million worth of inventory which included all of the guns, gun records and nearly two millions rounds of ammunition. The feds also seized all of the familys personal possessions, including their home, cars, bank accounts, jewelry, gold and coin collections all totaling about half a million dollars.
More than six months after being jailed, Terri Reese was finally allowed to post bail in March of 2012 and get out of jail, but her husband and two sons were denied the same opportunity because the prosecution claimed they were dangerous and posed a flight risk. The father and sons were held over pending their trials.
In July 2012, son Remington was acquitted of all charges and set free. Rick and Terri were each found guilty of one count of lying on firearms purchase forms. Son Ryin was found guilty on two counts of lying on federal purchase forms. All members of family were acquitted on the other 24 charges that had been brought against them.
Even though the trial was last July, Rick and Ryin Reese remain in jail pending their sentence hearing which has never taken place. All toll, the father and son have spent nearly a year and half in jail.

This bill subsequently attacks your privacy, establishes de-facto gun registration, as well as weakens the MN permit to carry.
When applying for your permit to purchase, police officers can extend the processing time for up to 30 days (instead of the current 7 days) under the guise of verifying your identity.
Currently, your permit to carry acts as a 5 year permit to purchase for the transfer of firearms. If this bill becomes law, you will need to get a permit to purchase every 12 months, on top of your permit to carry. This is an unnecessary redundancy, as MN sheriffs must check the validity of your carry permit annually.
This bill intends to allow the government to know who, what, where, and when you transfer a firearm to another party by requiring you to process all transfers through a FFL federal dealer. The government will keep track of all sales, transfers, loans, and gifts outside of immediate family.
Not only does this bill mandate that you involve a 3rd party in your private transaction, the government will have a say in the fees that are charged in a private transaction.

HF0244 Blame the Victim
Short Description:
Firearm loss or theft false report crime established, crime of transferring firearms to an ineligible person expanded, and a person convicted of these crimes made ineligible to possess a firearm.
This bill would shift the blame from the criminal to the victim of a gun theft, and would actually make people less likely to report a theft.
LOSE YOUR GUN, LOSE YOUR RIGHTS:
Anyone that has misplaced, lost, or had a gun stolen knows how scary that is.
This bill would criminalize those who falsely report their guns lost or stolen, slapping them with a gross misdemeanor charge, and the loss of their right to own a firearm.
This bill would have the opposite effect from the one intended. People would be reluctant to report their firearms lost or stolen, when they may have just been misplaced, because they dont want to risk being charged with filing a false report.
This means legitimately stolen guns could go unreported for a longer period of time, as law-abiding gun owners dont want to lose their rights.
BLAMES YOU FOR CRIMINALS ACTIONS:
This bill also increases the liability on law abiding citizens and businesses who sell their firearms.
Under current law, it is a crime to sell a firearm to someone you know is ineligible.
This bill seeks to lower the threshold to has reason to believe the buyer is ineligible or intends to commit a crime. This is an incredibly subjective standard which can and will be used to blame people who made a sale in good faith.
We cannot change the law to place the blame on victims of crime and innocent citizens.

PROVE YOURE SANE: Current MN law allows a Sheriff or Police chief to deny your permit application if he believes that there exists a substantial likelihood that the applicant is a danger to self, or the public. This bill lowers the threshold required for a Sheriff or Police Chief to deny the permit from substantial likelihood to likelihood. While that seems like a minor adjustment, it can pose significant problems for someone attempting to appeal a wrongful denial. What is far more shocking, this bill will give law enforcement the ability to require you to obtain a letter from a state licensed primary care physician or state certified mental health professional before they process your application. Amazingly, after this embarrassing harassment, once youve provided the letter they are under no obligation to take it into consideration. Currently, if you are wrongfully denied, you can appeal the decision to the district court. However, this bill significantly lowers your ability to successfully appeal an improper denial by lowering the threshold of the evidence required to deny your rights. Currently, if there is clear and convincing evidence that you pose a danger to self or others, your permit appeal can be denied. This bill seeks to significantly lower the threshold to a preponderance of the evidence. This means that if in the eyes of the court there is a slight chance you pose a danger to self or others, your appeal can be denied, sticking you with legal fees and a loss of your rights.
NON RESIDENTS RIGHTS DENIED: In order to carry in Minnesota, even non-residents have to take a carry class from a state-approved instructor, and follow the EXACT same process as a resident. Even though these people have been going through the exact same class, have needed to meet the exact same criteria, and go through the exact same application process, this bill assaults the rights of people who work in, visit, and pass through Minnesota with absolutely no cause. Contact the members of the committee below, and show up on the 5th, 6th, and 7th. Make it clear that law-abiding citizens will not stand for assaults on our rights, and legislation that will do nothing to prevent criminals from getting firearms.

If you own a semi-automatic firearm that can hold more than 7 rounds you will
1. Have to submit to another background check.
2. Register the firearm.
3. Safely and securely store the firearm.
4. Agree to allow the police to inspect the storage of the firearm.
5. Annually renew the registration, subject to the completion of a new background check.
6. Surrender any assault weapon you inherit or modify the weapon to render it inoperable.
