California faces backlog of 40,000 weapons in hands of felons, mentally ill

According to the state DOJ, that's nearly 40,000 handguns and assault weapons currently in circulation that shouldn't be.

As Capitol Hill begins to debate a raft of anti-gun violence measures -- ranging from gun control bills to proposals to improve screening and the mental health system -- California officials are trying to take matters into their own hands.

After Lindley testified at a hearing last week that his office lacks enough staff to confiscate weapons from felons and the mentally ill -- which are recorded in the state's Armed Prohibited Persons database -- lawmakers are fast-tracking a bill that would free up funds for that job.

But...but...but.. That’s impossible!!! California requires a back ground check for ALL firearms transactions including private sales, plus a ten day waiting period.

IF someone is indeed a convicted “felon.” Then I am for taking away their firearms...that has been the law for years.

However, I get nervous over taking away weapons from the “mentally ill.” How do you define it? IF they aren’t adjudicated as “mentally ill” then leave them alone until they are. I am concerned this will be used as an excuse to disarm any veteran that has been diagnosed as suffering from PTSD....even mild cases. Or, disarming anyone taking any psychotrophic medication (antidepressants or tranquilizers) to treat a “non threatening” mental problem, etc. The RUSH to blame “mental illness” for what is actually “human depravity” and the “breakdown of morality” is a cheap and useless fix.....one to be abused.

Do not let anyone disarm anyone without it being properly done in a court of law with checks and balances.

If you are mentally ill and own a gun, they probably won’t bother knocking on the door. Your 2nd amendment rights will not be the only one of your civil rights to be violated for the sake of gun control.

Exactly the answer I was looking for. The no felon laws have always been a bit convoluted. You do something stupid as a kid (other than mass murder/murder and rape) and serve time and and 20 years later cannot own a gun, I call BS.

Confiscation will come in graduate waves:

1. confiscation from mentally ill

2. confiscation from those with restraining orders

3. confiscation from those with history of domestic violence

4. confiscation from those with “other than legal” status

5. confiscation from patriots

6. confiscation from apolitical law-abiders

My local sheriff in NC just announced they are now requiring your medical records to get a handgun or ccw permit. I don’t know how serious they will be about substance abusers or anyone having taken meds for mental issues.

That's already done and was passed as part of the Violence Against Women Act. There was a doctor believed by many to be innocent, who went to federal prison for five years for possessing ammunition and/or a firearm (in his office, because of a report from his ex, IIRC). The Supremes refused to hear it, IIRC (Emerson case).

That's also already done from the VAWA, passed by both Democrats and Republicans in Congress--anyone with a misdemeanor DV conviction in his or her history.

That'll be the beginning of the end of firearms and ammunition possession for all. At least one of the bills seeks to force all states to report mental histories of all to the NCIC. A huge portion of the population has been in some kind of therapy/counseling or other at some time. Being a larger violated group, they'll be angry and numerous enough to help outlaw the Second Amendment for the rest of us afterward.

I suspect that's the plan from the few elite folks behind gun control, and they have big bucks for lobbying and campaigns. They can also afford to have ugly spots in their own histories wiped and/or to simply hire private security.

Another thing to consider: very few people would go anywhere near a psychologist or psychiatrist, if such a bill passed—only a few forced to, perhaps.

A finding by an open court (with testimony, etc.) would do. Empaneling a jury should be an option.

The people of your county need to “spank” him hard and boot his sorry backside out of office. What business is it of his to check someone’s medical records? This is exactly what I was afraid would happen.

We need to pass a state law criminalizing the infringement of the 2nd Ammendment by pompous state,county and local politicians,shills,and government agencies. A misdemeanor charge is minimum. If the security of our citizens is eroded, then treason should be applicable
