Family sues Golden Corral over ADA

WESTLAND, Mich., Feb. 21 (UPI) -- The owners of a Michigan buffet restaurant are being sued in federal court for allegedly kicking out a family whose children suffer from a rare skin disorder.

A lawsuit filed Wednesday against a Westland Golden Corral alleges the restaurant's owners, Kirit and Shakuntla Patel, violated the Americans with Disabilities Act by refusing to serve the family, The Detroit News reported.

The lawsuit alleges that restaurant manager David Robinson approached the family and asked Duford "What is wrong with your baby?" Duford said nothing was wrong and informed the manager about the skin disease.

"She has scabs all over, so obviously there is something wrong with her," Robinson allegedly said, adding that the restaurant had "a right to ask what's wrong if it concerns our customers and is contagious."

Good grief. The owner had every right to be concerned. It looks like it very well could have been something contagious.

I feel bad for the family but I think the restaurant has the right to keep other customers safe.
without knowing anything about the disease the manager did the right thing

This case should not even get to court.
but it will

OMG Why would someone bring a child into a restarant full of people with open sores..I would not have been able to eat..it would have made me throw up..

The owners were right ,but I can bet you some fool judge will give them millions of dollars..

When the blisters burst, they ooze. I wouldn’t want oozing wounds from some unknown desease all over my restaurant either.

It’s hard enough getting teenage employees to clean grease traps. Telling them to sanitize every last part of the restaurant that child’s oozing wounds might have touched would spark a mass walkout.

This is dumb.

I went to a Golden Corral in Alabama once. I took a look at the other patrons, lost my appetite, tried to eat a salad to get some of my money’s worth, and then went home.

Watching dozens of 300-400 lb. people eat without limits on portion size is disgusting. I refuse to go to another buffet.

This company does more to help people and vets than many I know. They have stellar mangement and hats off to them. The family should have ordered out. I wouldn’t want to sit next to that infection.

I wonder if businesses can counter sue in situations like this? This shopping for any excuse for litigation needs to have a cost to the losing party.

If I were the owner I would be quite concerned - he has a duty to inquire.

If I were the parents I’d be dubious about taking the children places where their sores are exposed to all kinds of germs - but I don’t know what guidelines the doctors have given them.

Surely the parents have met this kind of reaction before and should have some sort of pamphlet or doctor’s not to hand out.

Why embarrass a child with that disease by taking her into a public restaurant where people will stare at her.

Unless you plan to sue the owner.

The ADA was one of the most stupid laws ever passed, and has cost billions of dollars

“people’s understanding of the range of disabilities”

So here’s my plan:
I’m short and wear glasses.I’m acutely aware of this and it causes me anxiety.
So,I’m getting a handicapped plate and will be taking my dog with me wherever I go. She’s my “Emotional Support” animal.

And when some place throws me out...Cha Ching!!!

Here’s my thinking. If some whackjob with a beard and an Adam’s apple and wearing a dress tells me that he’s a girl and I have to treat him as such because it’s the law (I’m not kidding),then if I tell you I’m disabled then I must be disabled. My perception becomes someone else’s reality.

(do I really need the sarcasm tag?)
