The links to the story are not working, but I will inject my opinion:
That "man" was not defacing Zero's portrait but merely expressing his artistic freedom.

He could name it “Feces on Crap”.

It’s not a mural, it’s a political ad that’s past its time. And I doubt whether it’s worth very much, since a bunch of volunteers helped to repaint it. Ergo, not a Picasso.

I seriously doubt whether this would be treated as a felony if this were an old campaign poster of George Bush.

Why shouldn’t there be a felony charge here?

Saddam Hussein wouldn’t put up with it, Jung-un would do something, same with Ma0, Castro and Stalin. likewise, Same with Ø’.

If we were talking about a likeness of Mao Tse Tung having been added no criminal charges could have been lodged because Mao was obviously one of Osama Obama’s mentors...along with Saul Alinsky,Bill Ayers and “Reverend” Wright. The accuracy of Mao's image being added would have made the act one of free expression rather than “vandalism”.

For the prosecution, the issue will simply be an issue of criminal mischief in the destruction of private property. No different than someone going to property that you own and committing vandalism.

"Davis has a permit to carry a gun and says that by carrying the gun, it sends a message that just because people disagree with each other, they don't' have to resort to acts that will do harm."

Doesn't the owner know that is an assault rifle he's carrying -- and the supreme one doesn't like that! Funny how this is okay because it goes with something the liberals support - but bad for the rest of us...

Jeeze—has the US of A gone completely mad? When did we make “defacing” a campaign poster a crime—especially a felony?

Freedom of speech is, as I recall, the 1st Amendment to the US Constitution.

The problem is that Obama does not set gun laws in Texas and the property owner under the castle doctrine could legally shoot to kill a person who is in the process of vandalism.

“Freedom of speech is, as I recall, the 1st Amendment to the US Constitution.”

Do the local gang bangers in your neighborhood have the First Amendment right to enter your property and splash paint on your home?

1. It wasn’t his property so no matter what you feel about the subject, it was vandalism.

2. Charged with a felony; are you kidding? Vandalism is a misdemeanor and possibly could result in a civil suit as well but not felony.

3. Where else have we seen ‘dear leader’ murals everywhere? Hmmmm...

Freedom of speech is, as I recall, the 1st Amendment to the US Constitution.

So is the concept of private property. A right is something that can't infringe upon the rights of others. Just as you have no right to go into someone's home and tear up a book claiming free speech, free speech doesn't give him the right to damage someone else's private property.

We may not like the poster he damaged, we don't have the right to damage another person's property.

How does removing or covering up unattractive pictures become “defacing”?

Time to take down the campaign posters anyway. Or is the Current Regime going to maintain an “eternal campaign”?

The paint splash was a vast improvement.

“how is that a mural or artwork? are all campaign images now protected artwork?”

It is private property and we do no have the right to go splash paint on property that we do not own.

Again, Voir dire will be interesting and key to the trial.

And if the prosecution has a video of the accused vandalizing the private property, there is little or no chance that the accused will be found not guilty.

Good chance he will be counting the days with chalk on a prison cell wall.

Big Bro would be the government watching.

In this case it was the property owner monitoring the actions that took place on his property.

In Texas, the accused in damn lucky he did not get shot.

I would vote for a conviction and community service. He should be ordered by the court to spend one weekend a month neatly painting over unsightly graffiti in the town - starting with murals that celebrate communist or socialist icons of evil, such as Che/Stalin/Mao/Hitler/Chavez/Obama murals.

You are absolutely correct. Unfortunately many on our side have been falling into the left’s trap of ‘rights for me but not for thee’ attitude. They think it is fine to deface private property simply because they don’t like it. True conservatives should be protecting these rights even if they don’t like the subject matter.

What’s funny is I see many of those on this thread jumping on zot threads screaming private property when trolls come here and trash up threads. They understand the private property argument in that case.
