City Wants Power To “Disarm Individuals” During Crisis

Guntersville (Ala.) Mayor Leigh Dollar is working with city officials to pass an ordinance that would give police the power to “disarm individuals” during a disaster, a chilling example of how the second amendment is being assaulted via the back door.

The new rule would allow authorities to confiscate guns of “unruly” people during an extreme weather event such as the April 2011 tornadoes or any other emergency.

“The ordinance states officers could disarm individuals, if necessary, reports ABC 31. “Dollar says the proposal is just way to give officers more authority to protect themselves.”

Dollar denied that the ordinance would be used to take away constitutional rights, but residents questioned why authorities would need to pass a new ordinance given that police already have the power to arrest citizens who are being “unruly,” whether armed or not.

“Well, it seems like an infringement on the 2nd Amendment and that’s the biggest problem I have with it,” said Guntersville Music Academy teacher Paul Landry.

Authorities are seemingly attempting to mirror unconstitutional gun grab powers that were enacted in the wake of Hurricane Katrina in 2005.

In the aftermath of Katrina, the New Orleans Police, National Guard troops, and U.S. Marshals confiscated firearms. “Guns will be taken. Only law enforcement will be allowed to have guns,” New Orleans Police Superintendent Eddie Compass declared as he prepared to violate the Second Amendment.

The National Guard conducted warrantless house-to-house searches, targeting not just Hurricane-hit areas under the pretext of stopping violent looters, but also high and dry homes that were not even affected by the storm.

Authorities even confiscated pistols from old ladies, as documented in the video below..

The Guntersville gun grab ordinance will be on the city council agenda at their meeting on March 4th.

I remember seeing them knock down that old lady, take her gun and force her out of her home even though she was fine. Meanwhile the police and the criminals were havng a field day committing rape, robbery and murder. The gun confiscation of good citizens broke my heart more than any of the aftermath of Katrina.

Yeah. Let’s say they ask to come into your house to take your guns. You refuse. That makes you “unruly”, giving them the legal right to take them. ;-)

Do cops actually want the job??? The endless whining about their safety, at the expense of the public’s safety is sickening. They are supposed to be tough on crime, not afraid of law abiding citizens.

Yep same here, and yet even after Katrina I still hear gun friendly people saying “our government wouldn’t go door to door to take guns away”. Really?! They already have! Just not in large scale.

What's "unruly"?

Someone who is frantic searching for missing family members?
Someone who is defending his ruined house from looters?
Someone who is upset at FEMA after 2 weeks of no help at all?

Arrest or shoot looters and vandals, leave everyone else alone.
No new laws are needed to do that.

These people are setting up a scenario in which a LEO gets killed trying to disarm a desperate citizen during a disaster. Thus setting up “Proof” that the population can't control themselves and should not have access to guns. Period

That is certainly what it seems like. Needle and provoke until somebody snaps.
If that somebody happens to be a legal gun owner, we will all get punished.

The very fact that they are asking for this power deserves this question:

Why are you proposing to deploy scarce law enforcement resources in the event of an emergency to focus on firearm confiscation from the general citizenry instead of protecting them from the criminal element which takes advantage of these emergencies? And how does that make you different from the criminal element?

The only authority any government official acts under is derived from the Constitution.

When they act contrary to the Constitution, they have no legitimate authority, so resisting their illegitimate use of force is legitimate on the part of the citizenry.

There should be a recall underway for every politician who voted for this "law". Why weren't the citizens packing the council meeting with torches and pitchforks to make their objection known?

No way that this is Constitutional. If you legally own and possess your guns and are not engaged in the commission of a crime, the police have no authority to confiscate your guns no matter what some municipal by-law may say.

AAHHHH...yes...this is an old condundrum, isn't it, for weak pols?

Mayor Leigh Dollar is damned if she does and damned if she don't.

I suspect the mayor knows her citizens pretty well, ...what they are capable of and in fact what they do in certain circumstances.

So, she has to decide whether the heat of the 2nd amendment people will be less than the heat that she will take if there is a disaster and what always happens during a disaster, in fact happens.

Is her first duty to protect the citizens, or protect the Constitution?..

If it was me, I'd protect the Constitution, for if it is destroyed, there is no protection for anyone.

That is the money quote. The police are under no legal obligation to protect citizens, they are armed for self protection not yours or mine. And why would officers want to protect themselves against armed ‘peaceable’ citizens anyway? Are they afraid they might do something that would create an ‘unruly’ citizen from one that was formally peaceable? What truly infuriates me is that the authorities want desperately to disarm you leaving you defenseless all the while knowing that they are immune from any legal ramifications as US citizens have NO Constitutional/legal right to police protection. MOLON LABE indeed!!

You are correct sir. I have no problems with peace officers. I have a brother-in-law who is a leo for over 30 yrs. My uncle is a retired chief of police from two departments. Whenever an incident occurs with leo’s I always take a wait and see approach instead of jumping on the media’s bash the cops bandwagon. If they screwed up I say so, if they didn’t I defend the cops.

That being said if an officer decides to enforce this illegal law and gets wounded or killed and I am on the jury of the citizen they tried to disarm the citizen will walk.

The old line of “I was just following orders” was tried at Nuremberg, it didn’t work then and it won’t work with me now. The ballot box is a long gone joke. We are currently at the jury box and headed hell for leather for the ammo box. Sadly leo’s are going to have to decide in the future does their oath and principles mean anything or are they just doing their job and following orders.

My city was going to change zoning rules to allow businesses to be mixed with low density single family homes. It would have destroyed the value of the homes (mine included). The business twerps thought they had the city council by the nads. They weren't anticipating a city council meeting filled with angry citizens wall to wall and spilling into the halls and out into the parking lots. We made it abundantly clear that the council would not only turn down the rezoning, but they would pass a ruling that guaranteed that the rezoning would never be allowed. The city council members nearly crapped their collective pants. It was a shoot, shovel, shut up kind of crowd.
