A Maryland lawmaker has introduced legislation after a 7-year-old boy in his district was suspended for shaping a pastry into what his teacher thought looked like a gun.
The Star Democrat reports that Republican Sen. J.B. Jennings introduced a bill that would prohibit schools from suspending students for seemingly harmless childish acts, such as playing games with fingers pointed like guns or chewing food into the shape of a firearm.

A law where common sense should suffice isn’t the best option in my opinion.
People need to get off their butts and fix the schools.
They actually need a LAW for that???!!! Pathetic.
So sad that we’re at the point where a legislator has to even cosider proposing legislation like this.
Agreed. They need to discipline or fire the jerk who did this. They don’t need another law. They already have about a hundred thousand of them.
Common sense. Rationality. It’s what the kids need, and they aren’t likely to get it if none of their teachers have it.
Legislation like this from the Radical Right will never pass muster in heavily Democrat Maryland.
You're right, stupidity can't be legislated away. This should be handled locally with those responsible being fired. A few people losing their jobs would greatly discourage further stupidity.
I would be very, very interested to see a televised debate on this bill.
This should be handled locally with those responsible being fired. A few people losing their jobs would greatly discourage further stupidity.
That isn't going to work either. I'm sure the person or people responsible for this stupidity and similar stupidity regarding mark-believe guns and toy soldiers in our public schools, are protected by union contracts and cannot be fired for such stupidity.
The obvious alternative is to either use legislation to cut off the money (it's our money after all) or, if that fails, withdraw into conservative communities where we can control the schools and get rid of such stupidity.
To reduce this type of incident in the future, Maryland should have a pastry buyback program.
U R funny. Maybe all parents should send their kids to school with toy guns.
Yes, when you have to have laws to legislate common sense you know this country is screwed.
A silver lining in leaving things the way they are, is that kids will learn to disrespect authority, as it is an arbitrary force. The parents might pick up that lesson too.
Shame it takes a bill.
The time is coming where even mentioning the word gun will get a student suspended from school. Liberalism is that damned plague that will bring this country down.
“Maryland should have a pastry buyback program.”
The problem isn’t limited to pastry. Yesterday I saw an eggroll that looked like a supressor.
I was suspended for three days, when I was in high school in the 1960s, for having shirt tail out. My life was ruined by that one incident. I could only get the most lowly type of jobs, like busboy or "community organizer" and was turned down by Harvard even though I had a scholarship. /sarc>
Common sense should not require new laws. Laws should require common sense.
1. Michigan: School confiscates cupcakes decorated with Toy Soldiers A woman made a batch of cupcakes for her sons classmates. Her 9-year-old son decorated them with plastic soldier figurines. The mother was called shortly after delivering them and was told they couldnt be served because the soldiers had guns.
2. Maryland: Pop-Tart Pistol?: 7-year-old gets suspended for gun-shaped pastryThe child claims he tried to make it into the shape of a mountain but it turned out looking more like a gun. Obviously he was suspended for two days. PS- students are being offered counseling services if they were troubled by the pastry incident.
3. Colorado: Colorado boy, 7, reportedly faces suspension for tossing imaginary grenadeHe was just trying to save the world from evil forces but apparently that flies in the face of the schools no weapons, real or imaginary, policy. He doesnt understand why he was dispended, either.
4. Maryland: 6-year-old boy suspended for pointing finger like a gun got off easyJust suspension, not expulsion? The author of this article quips, Soon, six year-old children will be forced to sit indoors playing Sensitivity Training and delivering Powerpoint lectures to each other on Safety Within the Home and Workforce Best Practices.
If you want to fix it, fire those responsible for this nonsense.
Any teacher or school board member who does not have the intelligence and common sense to distinguish between a harmless childish action and a real gun threat is not sufficiently intelligent or mature to be teaching children right from wrong.
