After reaching deal, child sex abuse suspect is now a fugitive

A 52-year-old county resident accused of molesting a 5-year-old girl in February 2012 accepted a plea agreement last month on the sexual abuse charge. Attorneys reached a so-called “West plea” under the condition that a doctor would evaluate the suspect to determine his level of risk as an offender – which would help the judge decide an appropriate sentence ranging from probation to eight years in state prison.

Arnaldo Mateo Hernandez – also known as Arnaldo Gomez – was set for that doctor’s evaluation Thursday on the felony charge, lewd and lascivious acts with a child under age 14. Under the West plea scenario, suspects are not expressly admitting to guilt, but are willing to accept the related punishment if found guilty.

Hernandez failed to appear at Thursday’s hearing – after appearing at all prior hearings – and is now a fugitive.

Family members remain particularly upset that Hernandez – without any bail considerations – has been a free man through the entire process, the victim’s mother said in an interview with the Free Lance.

She said they are concerned Hernandez might eventually receive probation. She also contended he is an illegal immigrant and said she is worried that he would remain in the U.S. without deportation considerations.

“He’s not going to get one night in jail,” she said. “He’s not going get deported.”

Here is another open border fugitive of the week...The woman told police through an interpreter that she was talking on the phone to her children in Honduras while she walked in City Park around 7:30 p.m. on Jan. 19. When her cell phone battery died, she went back to her car parked on Dreyfous Avenue in the park.

She said she suddenly felt a tap on her shoulder and turned and saw Cordova. He told her not to be scared, that he didn’t want to hurt her but to “give her a memory” because he was about to leave, the warrant states.

Frightened, the victim tried to walk toward a better-lit area, she said. Cordova then grabbed her mouth and told her not to scream and to walk with him to his vehicle, she said. Cordova continued walking with her “as if they were a couple” until they got to his vehicle parked at Irby and Dreyfous avenues. He told her to get into the vehicle.

She refused and Cordova tried to force her into the vehicle, again telling her that he wanted to “give her a memory” of him, the warrant states. Cordova then held down the woman’s hands and kissed and bit her neck and breasts, according to the warrant.

The victim fought back and bit him until he let go of her, police said. Cordova allegedly teased her that she wouldn’t know how to call for help in English.

Eventually, the woman walked back to her car. Cordova followed her, grabbed her hands and forced her to touch his genitals, the warrant says. He asked the victim again if she wanted the memory. She said no, and he left. Cordova was booked on one count of sexual battery, records show. His bond was set at $20,000; however, he is being detained by U.S. Immigration and Customs Enforcement because of questions about his immigration status, records show. ..DHS are they thinking does Obama want him to be released or not to release... ???????http://www.nola.com/crime/index.ssf/2013/03/man_accused_of_attacking_ex-gi.html
