Texas Women’s Death Row Inmate Seeks Delay In Execution
KWTX ^ | March 22, 2013

Posted on 03/22/2013 10:47:39 PM PDT by nickcarraway

Convicted killer Kimberly McCarthy, who’s held on women’s death row in Gatesville, is asking a state district judge in Dallas to halt her execution, which is now scheduled for April 3.

McCarthy, who avoided execution with a last-day reprieve in January, asked State District Judge Larry Mitchell in a court filing Friday to put off the April 3 lethal injection until the fate of a bill related to issues in her case that was introduced March 6 in the Texas Legislature is determined.

Attorney Maurie Levin contends McCarthy's 1998 trial jury may have been unfairly selected on the basis of race.

A bill proposed by Sen. Royce West and Rep. Eric Johnson, both Dallas Democrats, would bar racial discrimination in capital case prosecution.

Levin argues that McCarthy, who’s black, was the subject of racial discrimination by the jury of 11 whites and only one black that convicted her.

McCarthy was convicted and sentenced to death in November 1998 for the July 21, 1997 murder of her neighbor, Dorothy Booth, 71, at Booth’s home in Lancaster.

Evidence showed McCarthy went to Booth’s home on the pretense of borrowing sugar and then stabbed the retired professor five times and hit her in the face with a candelabrum.

She cut off Booth’s left ring finger to take a diamond ring and nearly severed Booth’s left little finger as well, evidence showed.

She fled with Booth’s purse and wedding ring and later bought drugs with the stolen money, used the stolen credit cards and pawned the stolen ring, evidence showed.

On Jan. 7, the U.S. Supreme Court without comment, refused to review McCarthy’s case.

McCarthy is one of 10 women on women's death row at the Mountainview Unit in Gatesville, but the only one with an execution date.

Ya can’t blame a girl for trying. Still hope she’s dead before the baseball season opens.

“Jose Manuel Miguel Xaviar Gonzales, in a few short weeks, it
will be spring, the snows of winter will flee away, the ice will
vanish, and the air will become soft and balmy, in short, Jose
Miguel Xaviar Gonzales, the annual miracle of the years will
awaken and come to pass, but you won’t be there.”

“The rivulet will run its soaring course to the sea, the timid
desert flowers will put forth their tender shoots, the glorious
valleys of this imperial domain will blossom as the rose, still
you won’t be here to see.”

“From every-tree top some wild woods songster will carol his
mating song, butterflies will sport in the sunshine, the busy
bee will hum happy as it pursues its accustomed vocation. The
gentle breeze will tease the tassels of the wild grasses, and
all nature, Jose Manuel Miguel Xaviar Gonzales, will be glad,
but you, you won’t be here to enjoy it because I command the
sheriff or some other officers of the country to lead you out to
some remote spot, wing you by the neck from a knotting bough of
some sturdy oak; and let you hang until you are dead.”

“And then, Jose Manuel Miguel Xaviar Gonzales, I further command
that such officer or officers retire quickly from your dangling
corpse, that vultures may descend from the heavens upon your
filthy body until nothing shall remain but bare, bleached bones
of a cold-blooded, copper-colored, blood-thirsty, throatcutting, chili-eating, sheep-herding, murdering son-of-a-bitch.”

United States of America v. Gonzales (1881) United States
District Court, New Mexico Territory Sessions Taos New Mexico.

Honorable Judge Roy Bean
United States Judge

She did it. She must die. Nothing to debate about.

Might take a few liberal Democrats with her. Make Texas a better state

“Goodbye, Papa, please pray for me,
I was the black sheep of the family.
You tried to teach me rightfrom wrong.
Too much wine and too much song,
wonder how I getalong.

Goodbye, Papa, it’s hard to die
when all the birds are singing inthe sky,
Now that the spring is in the air.
Little children everywhere”...

I’m normally an easy going person, but that song makes me go into a murderous rage. Any DJ who plays that should be prosecuted for war crimes. Why would anyone listen to that?

This time, I hope she does not slither out of her MUCH deserved execution. Race has nothing to do with a defendant’s guilt or innocence. This witch just thinks a jury with more of her ‘homies’ or ‘sistas’ would have, at the very least, kept her off of Death Row or out of prison completely. She’s guilty. Exterminate this vermin and let the victim’s family have some peace.

Terry Jacks...Seasons in the Sun. (I used to be a radio DJ) I used to do some roadie stuff for disco DJs for a couple of years, it was a long time ago, and I still flinch and twitch a little bit while mentioning it, the noise will never leave my mind.

At least Seasons in the Sun was sweet and a person who was familiar with all the death and sadness of the late 60s and early 70s could hear something that while syrupy, was about death.

Any person who would murder someone and then cut off their finger to get a ring to sell for drugs is a cold hearted merciless piece of trash , and then she expects mercy from others.

Where was her mercy for the woman or women that she murdered?

It infuriating that the race card is being played...again

She is guilty...the color of her skin has NOTHING to do with her guilt...

No doubt if a white drugged out crack ho who murdered her elderly neighbor, she would already be worm food...

It would be sweet if the appeals court simply cited this precedent, substituting the name Kimberly Lagayle McCarthy for Jose Manuel Miguel Xaviar Gonzales, and modifying other personally identifiable characteristics.

re: the other two murders

A jury convicted her of capital murder. She was indicted but not tried for the 1988 murders of Jettie Lucas and Maggie Harding, both 85-year-old friends of McCarthy’s mother. Lucas was beaten with a hammer and stabbed to death in her kitchen.
