Before Congress enacts any new gun control laws, the nation’s law enforcement officers and courts should better enforce the regulations they have on the books now, according to U.S. Sen. Kelly Ayotte.
In a meeting with the Telegraph editorial board, New Hampshire’s junior senator took aim last month at the national background check system, which does not go far enough prosecuting those who illegally try to obtain weapons, she said.
"Of approximately 80,000 in 2012 that were denied (a gun) because of a background check … only 44 people were prosecuted for that," Ayotte said during the February 19 meeting.

I thought those were 2010 numbers. I remember LaPierre’s speech earlier when he said it was 2010 - 80,000 tried, 17 were prosecuted.
Anyhoo, I bought an XDs and a Rossi Rio Grande Thursday. By background check was denied because the guy in the shop entered my DOB wrong, and they had to do it all over again.
Kind of pointless anyway. Plenty of people aren’t supposed to have guns have them anyway.
Most are not prosecuted because they are false positives. That is they realy were not prohibited possesors, but ordinary citizens whose Second Amendment rights were illegitimately denied them.
That's entirely true, marktwain, and let me add this, please: having hung out and worked in gun shops, I've seen several people who didn't know they'd been convicted of felonies rather than misdemeanors, as well as one person who'd been told his conviction would "automatically disappear from your record," though it didn't. I suspect millions of Americans have no idea what the difference between felonies and misdemeanors might be, and the "punishable by more than a year's incarceration" is no help, since lots of people receive reduced sentences for first—and sometimes nineteenth—offenses.
That said™, very few people who knowingly attempt to buy guns in spite of being prohibited are ever prosecuted, nor are straw buyers. The so-called "gun control" laws both the U.S. Congress and more than a few states are rushing to pass are nothing both expressions of leftist extremist hatred of the Second Amendment and all of us who believe it means exactly what it says.

Quite true. One Brady Act prosecution in north Florida that I know of was ill-founded and resulted in a not guilty verdict in federal court because it was based on gross prosecutorial over-reach. In sum, the Brady Act is mostly wasted effort and expense, and the few prosecutions that result from it are seldom merited even when there is an apparent violation.

In order to prosecute them the gov’t would have to release 80,000 murderers, rapists and robbers back onto the streets to make room for these.
So all the authorities can do is arrest a few and hit them hard as a warning to the many.
Not at all clear to me that we should have form 4473 at all to begin with. If you’re not in jail, you probably should have your rights. What other right do you have to sign a document under penalty of perjury to exercise? You don’t even have to show an ID to vote.
Criminals buying guns... no problem.
Try not paying income taxes...
It’s not about disarming criminals or they would prosecute. It’s about disarming decent Americans.
