ALBANY -- As the legislature began the process of enacting a new state budget Sunday, its top Republican said Sunday they effectively will cancel a ban on the sale of gun and rifle magazines larger than seven rounds that was set to take effect April 15.

In doing so, Senate co-leader Dean Skelos (R-Rockville Centre) confirmed a plan lawmakers outlined last week.

-- Wasn't a soldier arrested for being in violation of this? What happens to him? --

No. The arrest was for the law as it stood before Cuomo's crap was passed. NYS already had a ban on large capacity magazines. He's awaiting trial.

-- We've not had a major 2A challenge to SCOTUS since Heller (individual right) and McDonald (incorporation to states). --

There is the "Heller II" case. Court of Appeals, DC Circuit, decided near the end of 2011. The decision was appealed to SCOTUS, and SCOTUS denied cert.

We conclude the District has carried its burden of showing a substantial relationship between the prohibition of both semi-automatic rifles and magazines holding more than ten rounds and the objectives of protecting police officers and controlling crime. Accordingly, the bans do not violate the plaintiffs' constitutional right to keep and bear arms.

Oddly, some of the people I work with call me a magician too. But if I were a magician, I could conjure up a job somewhere else.

So, I guess that leaves Colorado as the only state still planning on enacting this idiocy

The NYers really hung those Colorado senators who supported this for them out to dry, didn't they ?

They're all going to be facing recall elections, the two laws are going to be up for repeal on petitions; and even liberal Coloradonas will remember why you never trust anyone from the East coast..
