A Tucson gun store owner has decided to rescind the sale of a military-style rifle to Mark Kelly, the husband of former U.S. Rep. Gabrielle Giffords, after Kelly said he had intended the purchase to make a political point about how easy it is to obtain the kind of firearms he's lobbying Congress to ban.
Kelly's March 5 purchase of an AR-15-style rifle and a 45.-caliber handgun at Diamondback Police Supply sparked a frenzy of reaction from both sides of the debate after he posted to Facebook a photo of himself shopping.
A background check took only a matter of minutes to complete, Kelly said in the Facebook post, adding that it's scary to think people can buy similar guns without background checks at gun shows or on the Internet.
But Kelly couldn't immediately take possession of the rifle because the shop had bought it from a customer. As a result, the store is required by a Tucson ordinance to hold the gun for 20 days to give the city enough time to make sure the weapon wasn't used in a crime.

About 20 yrs ago this gun violence death clock was put up in front of the World Trade Center, of all places. by the Gun Fighters of America, a bunch of Brady Campaign wannabes. The funding for this eyesore came from a scam artist, Robert Brennan, who eventualy did time for securities fraud. Yeah, if I bilked lots of old folks out of their life savings, I'd be, shall we say, CONCERNED if their kids and grandkids had easy access to firearms.

Kelly filled out the 4473 attesting that he was buying the weapons for himself but stated openly that he was giving the AR-15 to a third party. He committed a felony! He should now be tried, convicted and imprisoned for falsifiying the record. He was a “straw buyer”!

I guess they couldn’t or didn’t want to put the percentage numbers up there of number of guns as a percentage of “gun killings” because it would show the miniscule number that it is huh? Guess they thought New Yorkers wouldn’t be able to figure it out on their own. Wonder what the number of “Guns in America” is now? Probably well over 300 mil.
Anyway, if the gun shop has stopped the sale because of questionable intent, will this be another case of the batfe NOT going after an individual (NON-enforcement!) for attempting to buy a weapon under false pretenses? They’d probably pay one of us peons a visit but they’ll tell mark kelly-giffords just to not do it again if they say anything at all now that he is in the privileged/protected upper class.
If they sold it to him knowing he lied on the 4473, they would be committing a felony.
Mark Kelly, by his admission the gun was not for personal use and his intention was to buy it for someone else, admitted committing a felony when he lied on the form.
I think a DA needs to look into his actions.
It should be easy for law abiding citizens to obtain a gun.

What a gun shop owner told me was that he was required to refuse any sale if he felt ‘uncomfortable’ about the sale. Someone buying a gun for someone else might act abnormal, so he was supposed to err on the side of caution.

But what if I filled out the form, with the intent to later on will the firearm to someone in the family, or sell it outright to someone else if I chose not to posess that firearm anymore...
I don’t believe I am compelled to fill out a transfer form for that kind of deal, if I am alive or not...Its my property, and I have the right to dispose of it as I see fit...(this is true in most states in this Union, IIRC)
But Mark Kelly’s intent was clear from the onset...Poorly thought out, and poorly executed...

Actually, a licensed FFL dealer can refuse to sell to anyone for any reason or no reason according to BATFE regulations.
BTW - other threads seem to dispute that Kelly committed a felony by falsifying the 4473 (gifting a firearm is cited as legal). If that is true, he should simply be incarcerted for being STUPID!

I believe in Arizona it is perfectly legal to purchase a gun and give it as a gift. If the third party gave him the money for the gun you are correct and he committed a felony.

IMO, and I’m not a lawyer but play one on FR, The store owner could flag him as a straw purchaser and he may not EVER be able to purchase another gun.( except of course for Eric Holder) He says we don’t really need them so why not?
I have purchased firearms as presents, but I defy you to purchase one being honest about it. Dealers are extremely gun shy (hmmm) about anything that faintly smells like a straw purchase.
While in Phoenix I bought a shotgun for my son, to do so, we had to fill out the forms in his name, so that the sale was officially to him. I simply paid for it.
IF they were honest, they would show how many of those gun deaths were suicides, how many were accidents, how many were criminals shot by criminals, how many were criminals shot by cops, and how many were innocent victims shot by criminals or cops. You would then see that the number of deaths of innocent victims from gunshot wounds is a small fraction of the total number of gun-related deaths. The largest number of gun deaths (over half the total) were suicides.
As a former FFL holder, I can assure that this is not the definition of a "straw buyer". IF a buyer uses his own money to buy a gun and then gives it as a gift to someone else that is legally qualified to own it, that is not a straw purchase. If another person gave Mr. Kelly the money to buy the gun (presumably because the first person could not legally buy the gun himself), and then Mr. Kelly bought the gun while representing that he was the true buyer of the weapon, that would make him a "straw buyer".
I know exactly what you mean and the law is basically splitting hairs between straw purchases and gifts. I live in Texas and have purchased a gun as a gift for my mother, who at the time was a Texas resident. If I sell or give a gun to someone who is also a resident of Texas, there is no paperwork required. To give a gun to someone in another state a transfer with background check is required. Had I given her the gun while she was a resident of another state, it would have been legal to be “on loan” but ownership could not be transfered until she became a Texas resident, or completed an FFL transfer.
The whole point of all this of course is not to prevent crime or guns in the hands of criminals but rather to put me in a tenuous legal situation regarding ownership of the firearm. I can only imagine a gun store owners fear of liability from navigating convoluted gun regs. Ain’t our laws grand.

The owner can’t take the chance BATF will come at him for knowingly aiding a “straw purchase.” Maybe this was the plan all along. Buy the gun, announce you are giving it away, then charge the SELLER with a crime! I think we all know Kelly would never be charged but the owner’s FFL would be in serious jeopardy.

But I still say the seller should not be able to rescind a sale made because he does not like what the buyer is going to do with the gun (as long as all laws have been obeyed and are expected to be obeyed).

Shortly after midnight tomorrow, 1,500 new lights will appear there, reflecting not just broken hearts but lives cut short.
It's the 7th one to the right. The new year will see the initiation of the Gun Fighters Deathclock, a three-story, red-white-and-blue, neon-edged billboard high above 47th Street in Times Square. The digital clock will offer an up-to-the-second tally of the number of guns in circulation in the United States, and the people who die because of them.
Every 5 1/2 seconds a gun will be added to the total, and every 14.8 minutes another death will be tallied.
"It's an ugly story, but it's an important story to tell," said Robert Brennan, the New Jersey businessman behind the idea. "If you want a message to be seen anywhere in the world, Times Square is the place."
Richard Wright, a resident of Saco, Maine, who was in line to buy discount theater tickets when the clock was unveiled yesterday, was not sure what good the clock would do, but thought it was worth a try.
"It couldn't hurt," he said. "It's a reminder, like any other reminder."
It won't be a gentle reminder.
This clock will be one of the 40 "supersigns" that have made Times Square a glitzy festival of color and lights.
But now, in addition to the Coca-Cola sign, the immense orange Suntory Whiskey sign, the five-story photo of a model sticking his hand into the top of his Calvin Klein briefs, the national-debt clock and the clock calculating "how much America has saved by using MCI instead of AT&T," will be the grim tally of the Deathclock.
It will turn a little piece of the Great White Way into the Grim Reaper's countinghouse.
It will pour forth, in 2 1/2 -foot digitized readouts, the number of people killed by guns in domestic disputes, robberies, drug deals, hunting accidents and more. The numbers displayed on the clock will reflect statistics from reports by the FBI and other government agencies.
Also on the board is a toll-free number that encourages public participation in a fight against handguns. The number: 1-800-WHY-GUNS.
The number connects to the sponsor of the clock, the Dehere Foundation, headed by Mr. Brennan, who said he established the organization to reduce violence in American cities. Callers will get information on how they can help work for gun control.
The foundation is named after professional basketball player Terry Dehere, a friend of Mr. Brennan's and a foundation board member.
During yesterday's news conference, Mr. Brennan said the clock was an effort to mobilize anti-gun sentiment around the nation. He has plans to put similar clocks up in other cities, including Los Angeles, Miami and Washington and in Newark, N.J., where he grew up.
Twenty-five years ago, Mr. Brennan's brother was shot and killed by robbers, but yesterday Mr. Brennan was reluctant to talk about it. "We're not here to rewrite history from 25 years ago," he said.
As the clock was being unveiled, New Yorkers were in the midst of a startling gun-surrender program, which offered people $100 toy-store gift certificates in exchange for any guns they turned in to police. The program was started by Fernando Mateo, who owns a carpet business in Manhattan.
