Classify this one as mixed feelings: I don't believe the gun seller has the right to rescind the sale based on the intent (that being a legal use of the AR15) of Mr. Kelly. On the other hand, this is the guy I would go to buy my next gun, were I in Arizona.

What a gun shop owner told me was that he was required to refuse any sale if he felt ‘uncomfortable’ about the sale. Someone buying a gun for someone else might act abnormal, so he was supposed to err on the side of caution.

Don’t know if that is true - not a gun shop owner, myself.

Actually, a licensed FFL dealer can refuse to sell to anyone for any reason or no reason according to BATFE regulations.

BTW - other threads seem to dispute that Kelly committed a felony by falsifying the 4473 (gifting a firearm is cited as legal). If that is true, he should simply be incarcerted for being STUPID!

The owner can’t take the chance BATF will come at him for knowingly aiding a “straw purchase.” Maybe this was the plan all along. Buy the gun, announce you are giving it away, then charge the SELLER with a crime! I think we all know Kelly would never be charged but the owner’s FFL would be in serious jeopardy.
