Supreme Court justices signaled on Tuesday that they are reluctant to embrace a broad ruling finding a fundamental right to marriage for gays and lesbians across the United States.
As sign-waving demonstrators massed outside, the court completed more than an hour of oral argument on whether to let stand a California ban on same-sex marriage without indicating a clear path forward.
Swing vote Justice Anthony Kennedy raised concerns about the court entering "uncharted waters" on an issue that divides the states.
Kennedy even raised the prospect of the court dismissing the case, a relatively unusual move that would leave intact a federal Appeals Court ruling that struck down the law, known as Proposition 8.
In a similar vein, Justice Samuel Alito also urged caution, noting that gay marriage as a concept is "newer than cellphones and the Internet."
None of the justices indicated support for the Obama administration's favored solution, which would strike down Proposition 8 and require the other eight states that already recognize civil unions or domestic partnerships to allow gays and lesbians to marry.
Earlier in the argument, the justices probed lawyers on both sides on the technical issue of whether California opponents of gay marriage had a right to be heard in federal court.
Although there was no apparent consensus on that point, if the court were to find the proponents did not have standing it would not reach the merits and then the federal District Court ruling that struck down Proposition 8 would be left intact.
U.S. citizens in general do not have a right to sue to enforce laws they favor. Chief Justice John Roberts pressed lawyer Charles Cooper, who represents gay marriage opponents, on why his clients are any different as they seek to enforce Proposition 8.

It wouldn't be a referendum, it would be an amendment to the constitution.
And what would be their basis for ruling that the constitution is "unconstitutional"?
If that is the case then we can dispense will all this foolishness about the rule of law.

People in this country haven't just taken a wrong turn, they've laid railroad tracks and are flying down those tracks with no way to stop or change direction other than by derailing the train and suffering through the huge train wreck that follows.
You are in a bad dream. A drug induced bad dream from the flood of female hormones in our water and food.
If someone deliberately added female hormones to the water supply, over time you would expect to see males become noticeably more feminine along with females becoming less fertile. That's exactly what we're seeing as between one half and two thirds of the hormones in contraceptives aren't absorbed by the woman taking the contraceptives and over time end up in the water supply.
Our water works clean the water the hormones are suspended in, but they don't remove the hormones. A hundred thousand or more children die because the culture of death spreads exaggerations and lies about the risks associated with vaccines, and people still fight over fluoride in the water supply, but no one cares about pouring female hormones into the water supply nonstop even though it's obvious that something other than "socialization" is at work changing the fundamental nature of people in society.
Eventually scholars in whatever civilization replaces us will debate how much the presence of large quantities of hormones in our water supply and food contributed to the collapse of our civilization just like they debate how much the presence of lead in the Roman water supply and food led to the collapse of the Western Roman Empire. It's small comfort, but the parasite non-civilization the culture of death is promoting can't stand on it's own and will collapse right along with Western Civilization it's sucking the life out of.
