John Dieter, a concealed carry permit holder from Houston Texas, had engaged in a defensive gun use (DGU) against robbers almost two years ago.
Even though Mr. Dieter hadnt been charged with a crime, the Harris County Sheriff confiscated and refused to return his pistol.
That was until Mr. Dieter contacted the Second Amendment Foundation. The e-mail below from Mr. Dieter details the story.

Subject: I got my gun back!
Ok, you guys know I NEVER send out group emails and such. But
Long story short: The Harris county sheriff took my pistol, and refused to give it back. For a year and a half I tried, contacting Lawyers, every single gun group, filing motions with the Court, doing everything I could possibly do, but no. Then, I contacted the SAF www.saf.org they made ONE phone call to the sheriff and the very next DAY HCSO called me and said Come pick up your gun.
Im not kidding, I contacted EVERY single supposed gun rights organization there was. They all said we cant help you or it will cost more than the gun is worth to fight it Except for SAF! They called me on the phone, asked me all the details, and then sweet talked the sheriff into actually Obeying the Laws of the State of Texas and the Constitution. I am going onto the SAF web site and making a sizable donation right now. And yall should do the same!
And you may be wondering what I did to get my gun illegally seized in the first place? My neighbors got robbed and the thieves ran off onto my property. (they had robbed her about 10 times before) My Sea Bee neighbor and I went out into the woods (Im on 50 acres of DEEP woods) to find them, and we found them. Held them till the sheriff got there, and they hauled then off to jail and convicted them. My local Deputy DID NOT take my gun, and didnt want to take my gun, but when the supervisor got there, he took our guns. Then the fun began.
I cannot stress enough how lucky we are as Americans to have the folks at SAF on our side! (i will not name the MYRIAD so called gun rights orgs that did nothing for me) if you want to know, contact me.
This is a victory for all of us. Do not let the injustice continue.
I woild like to have been on that phone call to hear what they said to him
I'm delighted that his lawful property was (finally!) returned to the gun-owner (and hero who helped defend his neighbor's property AND deliver criminals to the police), but I would have preferred to read that the sheriff had been severely and publicly castigated by, e.g., a judge.
Writing that on the wall and saving it to computer files.
Sheriffs are elected officials. I would start a campaign to get this guy into early retirement.
What is SAF’s web address???
“filing motions with the Court, doing everything I could possibly do, but no.”
Did he try contacting the state attorney general and charging the Sheriff with theft of property?
Do what I did - search on the name:
Is there a way to determine how the donations are spent? I recall hearing that SAF is among a number of activist organizations which spend only a small percentage of the money on the targeted cause. I want to know if that is or is not correct.
Do you honestly believe a SAG will charge a county Sheriff for theft in a case like this? Honestly?
“Do you honestly believe a SAG will charge a county Sheriff for theft in a case like this? Honestly?”
Here in NJ, or places like NY, California, no. In Texas, yes. In fact a friend from Texas told me there are laws on the books in Texas that subject LE to criminal penalties for such behavior.
Me'all can't afford it, but the thought occurred to me before you mentioned it. Great story.
