(Video) Travis County DA sentenced to 45 days for DWI Newsroom 4/19/2013
Sheriff's deputies have taken Travis County District Attorney Rosemary Lehmberg into custody after a judge sentenced her to 45 days in jail for DWI. Lehmberg pleaded guilty to the charge Friday after she was arrested last weekend. She later issued a formal apology and said she would plead guilty to whatever charge the county prosecutor thought appropriate. She did not ask for a plea deal or any special treatment.
Based on sentencing standards, it was not immediately clear how long she would actually spend in jail. Lehmberg said she hoped to put the matter behind her and continue in office, but there are calls for her resignation.
The Austin American-Statesman released an editorial on Friday calling for her to step down and one resident has petitioned for her removal.
Yes, indeed. And the Travis County DA enjoys a peculiar importance under the Texas Constitution.
Remember the name Ronnie Earle? Earle was the Travis County DA who indicted Cong. Tom Delay. And Sen. Kay Bailey Hutchison.
The Travis County DA enjoys prosecutorial authority over all elected state officials and Texas' elected federal officials.
Historically, elected Travis County DAs (always Democrats) have made life a living hell for all Republican state and federal officials.
45 days would be a 2nd offense here in TN. A 1st offense calls for 48 hours (2 days) usually served from Friday night until Sunday. I don’t know Texas law but maybe they have an enhancement based on the BAC even on a 1st offense?
The usual first offense DWI here in Texas is a lot more for us little people.
I think the dash cam video and jail video may have been the basis for the harsher sentence. She is lucky this didn’t happen in Williamson county.

Rosemary; Getting dumped by your girlfriend sucks, but don’t go on a bender because of it. Might cost you your job.
The picture of her being cuffed in the courtroom reminds me of a Law and Order SVU episode where Christine Lahti shows up late for court and drunk. She was administered a breathalyzer test right in the courtroom for all to witness.
Side note: it used to be customary for some Texans to have a “roadie”. That’s what I remember growing up. Oh, and loaded guns on tables.
There are still a few of us that grab one for the road. I have done that coming home from work now and then.
OMG, they just said the court records indicate she weighs 210 lbs and her BAC was .23 and that was after she had been in the booking unit for over three hours. No wonder she got 45 days.

She HAS to resign.
I doubt she’s in for more than a few days. Certain days, like weekends maybe, count double. If they do let her out before the sentence is up to return, and the jail is full, they won’t put her in but will count that toward her sentence. If she does virtually ANY work in the jail (taking out trash, cleaning, etc.) she’ll get extra days’ credit for that.
Just do me one favor: don’t ask me how I know all this!

Never, never go into Travis county. It is the stupidest place on earth. You should see some of the stuff the Austin city council passes, like their latest ban on all plastic bags in retail stores. It is shameful it is our state capital.

Actually, I live in Travis county, but have to go through Williamson county to get to Austin. We are in the far NW corner, and it is as conservative as Williamson.
So how do we go about replacing her once we get her to resign? I have a little free time on my hands :)
I am out past you a bit built have to come south on occasion.
Someone filed the request to have her removed from her position. IF that happens, Gov Perry could assign the most bad ass conservative to that position. That is why she will not resign.
