No Miranda rights for now for bombing suspect

The Boston Marathon bombing suspect captured Friday night will not be immediately read his Miranda rights, a Justice Department official said.

The announcement came as a debate broke out among lawmakers, lawyers and political activists over whether the suspect, Dzhokar Tsarnaev, should be prosecuted in a civilian criminal court or subjected to military interrogation and over when and whether Tsarnaev should be told about his right to an attorney.

From what I understand the Government can’t send an American citizen to gitmo and this piece of excrement is an American citizen albeit by naturalization. Unless the government revokes his citizenship he can’t be interned at gitmo and his citizenship can’t be revoked until he is convicted. Catch 22

As an "enemy combatant", however, Tsarnaev can be tried in a military court.

How long until they label freepers as terrorists and take away our rights as well?

I agree.

This is a slam dunk, but most of the time the situation isn't as clear. And as they say, one man's terrorist is another man's freedom fighter.

And I sure as hell am not a liberal nor a democrat. I am a registered Republican and died in the wool American. Who, if the Republican don’t get their collective sh$te together will vote independent in the next election.

Not so fast. Did he tell they truth, under oath, at his naturalization ceremony? If he did not tell the truth, is he a citizen?

10 years from now Tsarnaev will be either still waiting for his case to be heard, or filing appeals from the verdict.

He can grow a beard and avoid any trial indefinitely.

Absolutely correct.

However, he can still invoke voluntarily.

I always advise invoking - whether under arrest or just being questioned. Before the cops even get a chance to say anything, you state that you want legal representation. Then, they can't talk to you.
