The White House said Monday that the surviving suspect in the Boston Marathon bombing will not be treated as an enemy combatant, in response to calls from Republican lawmakers to consider that option.
The announcement came as a sealed complaint was filed against suspect Dzhokhar Tsarnaev. Fox News has learned that the suspect made an initial appearance in front of a federal magistrate judge at the hospital where he is still being treated. No plea was entered.

no, this is what they did to macveigh. he’s a us citizen on us soil. if we lose our constitutional protections in this case, it will set a dangerous precedent. we can’t have justice by lynch mob.

I cannot disagree with that. He's a US Citizen. Probably should not be but he is.
Since there is no enemy
There is no enemy combatant.
The captured guy is therefore a criminal
If there is no war
there are no warriors
only criminals murder
The logic is unassailable if you accept there is no war

It would have been interesting if his brother had survived. Then we might have had one in military court and one in federal court.
I have a problem with Enemy Combatant Status for American citizens (e.g., being stripped of all rights), because any of us could be next.
Poor kid. And if they try him in NY, he’ll probably be acquitted.
Can you at least disagree with his term “lynch mob”?
Frustration, I believe. They know very well that even if the terrorist was not a citizen on the US, Zero would still make the same decision.
O.J. got an open court trial.
How informative was that? What kind of Justice was achieved?
The Administration will just use this trial the same way, for its own ends, and not for Justice or to uncover the real threat.
