A distraught mother came to News 4 after her 20-year-old daughter was fired after missing work for training duties with the Missouri National Guard.
Morgan Johnson was sworn in to the Missouri National Guard on April 18 and told her boss at the Crystal City Subway she would miss work to train with her unit that next weekend.
She was fired the following Monday even though a federal law protects her from losing her job over military service.

There’s gonna be a management position available in a Missouri Subway.
I just bet she “told her boss” and didn’t “ask her boss” to rearrange the work schedule
seriously this is about a 20 yr old working at a fast food joint? Her life is ruined! waaaa
Idiot power tripping boss just lost her job.
Not knowing the law isn’t an excuse for breaking it.
So you are agreeing with Subway? Don’t think its a good thing to encourage military participation? Having a hard time with that rectaloctalitus?
I am disgusted by your post.
Even if she DID “tell” her boss, that’s all she has to do.
If you are going to train, you have to GET PERMISSION to TRAIN.
Good grief. You typically post more reasonable and intelligent posts silverleaf.
And she doesn’t just work at a fast food joint, SHE JOINED THE MILITARY. So you never worked at a fast food joint before you started your career. How lucky for you.
Well, now we know just where Subway... stuck their footlong---
Pardon me, you DON’T have to get permission to go with your unit to train.
So the military is supposed to rearrange THEIR unit training around this idiot Subway manager’s schedule?
Bah! Still disgusted silverleaf and can’t comprehend where your statement came from. Maybe someone hijacked your Freeper account.
seriously this is about a 20 yr old working at a fast food joint? Her life is ruined! waaaa
What an idiot. She didn't have to ask her boss to rearrange anything, the law says she has the right to go train and if she lets her boss know that is all that needs to be done. She isn't required to ask permission. The boss is in the wrong here not the girl.
Serious bad PR move, and illegal
Boss looks like a typical alternate lifestyler to me. I’m thinking there’s more to this story. I’m also thinking this will get reversed and the samitch shop supervisor on the power trip will be taken down a notch. having said alll that, in this country nowadays maybe not............
Most likely there is a 20 something “BOSS” who is not a real manager and has no HR training. I doubt this is a case of anti-military so much as it is a case of ignorance.
Sorry, that’s not how it works.
If you have drill this weekend, you TELL your boss you have drill and by law he HAS to give you off.
Lots of businesses lately have taken the “Oh, they didn’t tell me!” tack.
Securitas Security Services USA for one.
I have actually had this issue happen to me. Before I was active duty, I was a DSG (drill status guardsman...part-timer). I worked at a company that decided it wasn't going to be very friendly to my training. they told me I either had to take vacation or arrange a "swap" for the days I would miss for UTA weekends. And so I did...for 2 years...and missed a LOT of UTA's because I was working and couldn't get a swap or didn't have the vacation.
THEN...I got the USERRA briefing at work one weekend. I went into my boss's office the next Monday and informed him that what they were asking me to do was against the law. They (him and the next in line) told me that was the policy...but that they would check with their company attorneys.
SHOCKER: I was called BACK into the office 4 days later...and it was determined that "I had misunderstod them" and that SURE I don't have to take off for UTA's...and NO WAY do you have to arrange a swap (even though I had been doing it for 2 years...and even missing drill because of it). They were glad they could clear up my misunderstanding.
After "discussing" the issue for about 30 seconds...and realizing their attorney had told them to not admit guilt...I just smiled and said "yeah...right." and left.
So...she has tell her boss...and it's curteous to let them know ahead of time...but she doesn't have to. She doesn't have to ask...and she can be gone for up to 4 years for training and her job has to be there when she returns (or an equal position). Get smart about the law before you comment.
Sworn in on a thursday, and takes off the next weekend? Not really thoughtful of her.
Maybe you can move up the ladder and get her job.
"most likely.." "ignorance" Gee, it peeves me when people post when they clearly have not read or watched a video. How can you post about ignorance"
“I’ll take Obtuse FR Posts for $200 Alex.
That “20 year old” is going to serve her country and defend our freedom. How dare you mock her.
Let’s see now. She was sworn in on the 18th of this month and this weekend she’ll be performing her National Guard training?
A 20-year-old’s contribution to the state’s NG is negligible. The time frame here would indicate that she really doesn’t give a damn about her submarine sandwich making job.
her “distraught” mother contacted the news? I have experience about what makes someone “distraught” . Waaaa.
Maybe this warrior should have chosen ... wisely....
between serving her country and serving subs, signing on with an employer that requires weekend shift work that someone else has to cover. But no, we want our “rights” and we want it all, and you owe me.
Or Ima get all “distraught” about my victimhood.
When I joined the military I quit my menial job(s) so someone else could handle it. Whatta dumshit, maybe I should go back and demand they reinstate me.
Ask not what your country owes you
How many people here mocked Kerry or Gore for their service?
“I just bet she told her boss and didnt ask her boss to rearrange the work schedule”
Guess what, stupid, she doesn’t “ask” when it comes to orders the military gives her to show. “Sorry, my boss says you military guys must rearrange your schedule. I have to work that evening.”
This is why we had to make a law that protects people that receive orders to serve; to protect them from morons like you that think a boss is a god of sorts.
Can’t defend your post, so you come back and choose one poster to puff your chest at and throw gorilla dust to?
The law says, “Your job must give you time off for drill.”
And instead of going, “Oh, okay.” you come back with this lame post.
Thanks for letting us know.
Hey gang, check out post 22 for all you need to know about silverleaf.
“Maybe you can move up the ladder and get her job”
Oh, come on, we all know he’s the temporary associate assistant weekend shift supervisor at Subway.
Yeah, john “I was in cambodia on christmas” Kerry and AlGore “I have a bodyguard”.
Sorry, not the same.
“When I joined the military I “
I call bullsh*t. If you were ever in the military then you know you don’t “ask” a civilian if you can go when ordered.
“How many people here mocked Kerry or Gore for their service?”
We didn’t mocked their service, we mocked them and how they conducted their service; from Gore that was never allowed to do the dangerous missions others were asked to do because his daddy was a Senator to Kerry that lied to get medals and then dishonorably threw them away, not to mention Kerry got a formal reprimand from the Navy.
Why? Actually being in VietNam, is not as patriotic as being in the NG?
OK, that’s way better. thanks
Uh, Kerry LIED his butt off to get medals.
Al Gore didn’t do sheepdip besides have a bodyguard.
He shirked duty because he was a senators son.
If you’re going to claim it, actually BE it.
Back around 1978, my stamping plant in Detroit sold off its wheel and brake division, laying off several hundred employees. Most of them had low seniority so they had recall rights of 3 years. Meaning, they remained on layoff status until the 3 years expired then they were terminated.
One of those employees subsequently joined the Army for 4 years. Following his discharge, he returned to the plant to try and start work again. Since his job no longer existed and his 3 year recall rights had expired, we had no choice but to tell him he had been terminated. Technically we were correct because that was the language in the UAW contract and the plant UAW bargaining committee agreed with us.
Well, he appealed it to I dont remember who but ultimately it ended up in the hands of an Arbitrator who ruled that the company was wrong in terminating him and ordered us to reinstate him to layoff status and recommence the 3 year recall right clause effective with his date of military discharge.
He was then able to sign up for the layoff pool and was placed in another department when an opening became available.
This was a very unusual case because the law ultimately superseded the companys bargaining agreement and granted this guy super seniority over everyone else he got laid off with who ultimately were terminated.
Ironically enough, the guy was fired within four months for excessive absenteeism. (Knowing the guy's employment record before he got laid off, I knew that was coming...)
We have standards, you should look into such a thing. Thanks.
If I had a business there, I’d hire her in a minute. Subway needs to fire that boss immediately.
I bet once this story aired that young girl was bombarded with job offers.
Many employers would and SHOULD embrace someone that signed up to defend this country. I think this girl will end up with a better job although there’s nothing wrong with working fast food.
Again, that’s not how it works.
You swear in and if the unit you are assigned to has their next drill tomorrow, you’d better darn well be there.
Even if you’re in civvies, they will expect you there.
The boss is in the wrong.
Subway seriously needs to shake-up it’s Marketing Department.
First the foot-long fiasco and now this.
I’ve just decided there are other places I can buy my lunch when I’m out and about.
You are correct, I did not watch the video at the time I posted the comments. I did base my perceptions on the written article.
However, after reviewing the video, there is NOTHING in the video that does away with the possibility of ignorance on the part of the manager.
Assume the hogie slinger didn’t tell the boss (remember these are very small outlets with few people) that she’d decided to be a weekend warrior. Then a few days after hiring she’s off for a weekend of fun and games.
Besides, being a former soldier, I don’t have much use for females who wish to augment their meager wages by signing up for the NG
“Assume the hogie slinger didnt tell the boss (remember these are very small outlets with few people) that shed decided to be a weekend warrior.”
Doesn’t matter, the law still says what it does.
He still has to give her the time off.
But, but, but bosses shouldn’t have to follow the law if it’s inconvenient!
Yeah, so they tell me here in NY.
She told her boss as soon as she found out that she had been ordered to a drill weekend for training.
She signed up on the 18th, I doubt she expected to be called up to report to training 2 days later.
Exactly! There are definitely Freepers who belong to the Holy Church of Capitalism and worship at the alter of “The Boss.”
Exactly, and he had to by law give her the time off.
