Subway Fires National Guard Member for Serving

A distraught mother came to News 4 after her 20-year-old daughter was fired after missing work for training duties with the Missouri National Guard.

Morgan Johnson was sworn in to the Missouri National Guard on April 18 and told her boss at the Crystal City Subway she would miss work to train with her unit that next weekend.

She was fired the following Monday even though a federal law protects her from losing her job over military service.

I am disgusted by your post.

Even if she DID “tell” her boss, that’s all she has to do.

If you are going to train, you have to GET PERMISSION to TRAIN.

Good grief. You typically post more reasonable and intelligent posts silverleaf.

And she doesn’t just work at a fast food joint, SHE JOINED THE MILITARY. So you never worked at a fast food joint before you started your career. How lucky for you.

Pardon me, you DON’T have to get permission to go with your unit to train.

So the military is supposed to rearrange THEIR unit training around this idiot Subway manager’s schedule?

What an idiot. She didn't have to ask her boss to rearrange anything, the law says she has the right to go train and if she lets her boss know that is all that needs to be done. She isn't required to ask permission. The boss is in the wrong here not the girl.

Boss looks like a typical alternate lifestyler to me. I’m thinking there’s more to this story. I’m also thinking this will get reversed and the samitch shop supervisor on the power trip will be taken down a notch. having said alll that, in this country nowadays maybe not............

Most likely there is a 20 something “BOSS” who is not a real manager and has no HR training. I doubt this is a case of anti-military so much as it is a case of ignorance.

Sorry, that’s not how it works.
If you have drill this weekend, you TELL your boss you have drill and by law he HAS to give you off.
Period.
Lots of businesses lately have taken the “Oh, they didn’t tell me!” tack.
Securitas Security Services USA for one.

Uh...No...she doesn't have to "ASK" her boss. She has to inform her boss. That is the law. It is then up to her BOSS to rearrange the work schedule.

I have actually had this issue happen to me. Before I was active duty, I was a DSG (drill status guardsman...part-timer). I worked at a company that decided it wasn't going to be very friendly to my training. they told me I either had to take vacation or arrange a "swap" for the days I would miss for UTA weekends. And so I did...for 2 years...and missed a LOT of UTA's because I was working and couldn't get a swap or didn't have the vacation.

THEN...I got the USERRA briefing at work one weekend. I went into my boss's office the next Monday and informed him that what they were asking me to do was against the law. They (him and the next in line) told me that was the policy...but that they would check with their company attorneys.

SHOCKER: I was called BACK into the office 4 days later...and it was determined that "I had misunderstod them" and that SURE I don't have to take off for UTA's...and NO WAY do you have to arrange a swap (even though I had been doing it for 2 years...and even missing drill because of it). They were glad they could clear up my misunderstanding.

After "discussing" the issue for about 30 seconds...and realizing their attorney had told them to not admit guilt...I just smiled and said "yeah...right." and left.

So...she has tell her boss...and it's curteous to let them know ahead of time...but she doesn't have to. She doesn't have to ask...and she can be gone for up to 4 years for training and her job has to be there when she returns (or an equal position). Get smart about the law before you comment.

Having spent three years in the Marine Corps, and then (13 years later) almost three years in the MC Reserve ...
... I can tell you that just joining the military does not make someone automatically eligible for sainthood.
