A police officer fired for driving drunk in an unmarked police car while off-duty has filed a $6 million lawsuit against the city of Gresham, the police chief and others, alleging his rights were violated under the Americans with Disabilities Act.
The lawsuit filed in Portland alleged the officer, Jason Servo, was suffering from alcoholism, a recognized disability under the act, and shouldn't have been dismissed.
The suit also alleged Servo was denied due process, and the police union failed to represent him adequately.
"Just as with any type of disability or disease, they should have made some kind of effort to accommodate that, or some kind of effort to work with him, and not simply sever all ties," said Shawn Kollie, one of Servo's attorneys.

What? Are they trying to argue that a cop can’t lose his job if he’s a drunk getting busted for drunk driving? WTF?
Can you imagine the cop trying to tell that story at an A.A. meeting? It’s not often somebody gets laughed out of an A.A. meeting but I think that would do it.
Does that mean instead of a few beers a couple of times a week, I get sloshed by noon six days a week I can collect a disability check? Show me the money!

I always thought a disability was a physical or mental affliction beyond one’s control. I have never seen a beer forcing itself down someone’s throat.
Furthermore, with that ‘defense’ how can he possibly enforce the laws he has sworn to enforce?
“Yes, I am driving drunk, occifer.”
“No worries mate, you can’t help it. Have a good night and try not to kill anyone when you are driving home.”
Drinking is a choice not a disability.
Can I volunteer to be on the jury?

The leftwing A$$holes in charge of disability claims to get Social Security disability payments have very quietly listed alcoholism as a disability.
Not only do the revolving door drunks get monthly checks for their “disability”, they often get housed in some rather nice treatment facilities and receive expensive so called treatment by the pseudo medical providers, all of which are paid for by our tax $’s.
