Its not really Constitutional Carry, which four states enjoy and another (Arkansas) will have later this summer, because local home-rule government units can place restrictions (albeit, probably unconstitutional) and may try to make an arrest of an Illinois gun owner carrying concealed or otherwise.
Of course, if they choose to make an arrest based upon a local ordinance that regulates transportation or possession of a firearm thats contrary to the Seventh Circuits Moore decision striking down the Illinois prohibition on carry outside the home as unconstitutional, they will be risking a 1983 lawsuit for damages. Section 1983 suits deal with the violation of civil rights under the color of authority.
Our advice: After June 9th, if we dont have a carry law in Illinois, strap on your heater if youre so inclined. Concealed means concealed. Dont run your mouth about it. Dont play with it over the course of the day. Have some training before you carry and know the rules for justifiable use of deadly force. And for heavens sake: be careful.
Concealed means concealed.
While the Seventh Circuits decision striking down Illinois Unlawful Use of Weapons statute would mean that you could carry a rifle in public, we wouldnt recommend it.
Whats that expression about inviting the man into your life?
Just dont do it.
IMO gun control is a throwaway issue for Illinois pols, but one the Big Ds have to make to their scared white liberal base in the city. The big issue is to remain in charge so they can swindle the big dollars, and Madigan is the boss.
“...Have some training before you carry and know the rules for justifiable use of deadly force. And for heavens sake: be careful. ...” “Concealed means concealed”
Sound advice in ANY AND ALL instances!
I am confused. Why must IL pass a law or face automatic legal carry? What court case?
Please spell out the issue and explain the legal interpretation that leads to this conclusion. I live in IN. How would Reciprocity be affected? Can I peaceably travel through the state?
Thanks for any help.
I have to think the thugs in Illinois are freaking out about now.
Constitutional or Permitless Carry in Play in Several States
About half way down the article, with links.
Yes, that is the case. But you will go to jail trying to “carry” in IL. The local LEO’s will just arrest you and let someone else handle it.
That’s buried in the article:
“the Seventh Circuits Moore decision striking down the Illinois prohibition on carry outside the home as unconstitutional”
just make sure you have an FOID card....
