South Carolina teacher who stomped on American flag in class gets $85,000

CHAPIN, S.C. — A South Carolina high school teacher removed from the classroom when he stomped on an American flag while discussing freedom is being paid $85,000 to avoid a legal challenge.

The State newspaper (http://bit.ly/13eJez6) obtained documents under the Freedom of Information Act that show Chapin High School teacher Scott Compton is being paid the settlement by Lexington-Richland District 5, in addition to his salary through June 7.

Compton resigned as part of the settlement after criticism about his actions last December.

Hey, if nothing happens between now and October 31st, that might be a very good time to decorate his lawn, as kids used to do, no?

If you don’t remember what we kids -used- to do, I’m talking ‘60’s here, there were a few houses, and a few base housing units, that seemed to draw out all the love there was, from the kids, on that night.

I suggest, you surmise!

I love how freepers have not changed over the years, he resigned, which means he no longer works there.

Point two, while I would NEVER do such a thing it is free speech, and is therefore protected.

People in SC should vote out this school board, but they only support people there with name ID, which challengers often lack.

He does, but in the circles he travels he will be a hero.

As the Presidential elction results of both 2008 and 2012 demonstrated, there more people now who hate America than people who love America here. And they vote. They chose,in my opinion, to put the individual[I do not refer to it as human or a man]who hate Amrica more than anyone else in the world in the White House. Not once but twice.

Probably not the sort of thing we want ~

As the Supreme Court told us, gub'mnt agents ~ and teachers are gub'mnt agents and cannot be viewed otherwise ~ have no free speech rights to be respected on the job!

The error was the lawyer for the school district forgot to cite all the USSC free speech cases involving SCHOOLS!

All is not lost. Just last night my son saw a flag in the middle of the street and swerved a little to avoid it. About a third of a mile down the road he found a place to park and walked back to get it (it was on a bridge). While I watched him get further away, an older truck did a u-turn and drove back up the bridge. As my son came back to the car without the flag, I asked if the guy in the truck picked it up. He said yes. So, 2 men out of how many went to retrieve it. My son is a Marine, and where we are (NC), I would be safe to assume the guy in the truck was too.

U.S. Code Title 4, Chapter 1, Section 8

This code is the guide for all handling and display of the Stars and Stripes.

It does not impose penalties for misuse of the United States Flag.

That is left to the states and to the federal government for the District of Columbia.

Each state has its own flag law.

Criminal penalties for certain acts of desecration to the flag were contained in Title 18 of the United States Code prior to 1989.

The Supreme Court decision in Texas v. Johnson; June 21, 1989, held the statute unconstitutional.

This statute was amended when the Flag Protection Act of 1989 (Oct. 28, 1989) imposed a fine and/or up to I year in prison for knowingly mutilating, defacing, physically defiling, maintaining on the floor or trampling upon any flag of the United States.

The Flag Protection Act of 1989 was struck down by the Supreme Court decision, United States vs. Eichman, decided on June 11, 1990.
