Congressman on IRS Scandal: Koch Bros. 'Abused the System'

Congressman Alan Grayson (D – FL) told Breitbart News he thinks the “Koch brothers have abused the system by setting up 501c3’s that are doing political activity,” arguing, “It doesn’t make any sense to look for something on the other side, because it’s not there,” he said, adding, “You just can’t find something that’s similar to what the Koch brothers and other right-wingers have done, so in that sense, it’s not shocking to me that the IRS did what it did. You have to look for things where they are to be found.”

Democrats play book:

Rule #1: Claim that Republicans did it too even though they didn't. The low information voters wont know anyway.

Rule #2: pass more laws. Don't care what laws. Just pass more laws so that people think you are doing something about it.

Rule #3: hope that low information voters won't be interested in the scandal and it fade away in a couple of weeks.

As I understand it, there are two different types of organizations being talked about: 501(C)(3) organizations and 501(C)(4) organizations.

The 501(C)(3) types are not allowed to engage in partisan political activities while the 501(C)(4) can do so, as long as such political activity is not the organization’s primary mission. My understanding is that the IRS scandal involves the 501(C)(4) types.

Is my understanding correct or have I misunderstood something here (entirely possible)?

I think an excellent case can be made that a lot of existing 501c3’s are political in nature, and that the laws against their doing political work while retaining tax-exempt status should be better enforced.

This is like arresting someone in a movie theater BEFORE he yells FIRE because we think he might.

Well, no.

The groups apply for special tax-exempt status, and obviously have to meet certain criteria to deserve that status.

It is entirely appropriate to have reasonable investigation done before granting this status.

Of course, targeting applicants by ideology is not “reasonable.”

I’m not sure if they went after 3’s or 4’s. I assumed they targeted both. There may be more 4’s than 3’s because in general its hardest to get a 3 approved.

The benefit of a 3 is to receive tax deductions on contributions.

The benefit of a 4 is to avoid any income tax on revenues. Most similar 4 organizations probably would do just fine without a tax exemption because they are not making money.

As far as political organizations go, the most common way for a 3 to get around political issues is to hide behind the education bush. For example, they claim their purpose is to educate people on climate change, women’s rights, discrimination etc.

The tax issue for the IRS for 3’s is that because political contributions are not tax deductible, is to stop people from getting a tax deduction by using a charity as a front.

I’m not sure about all the reasons someone wants recognition as a 4 because there is in general no tax benefit unless they accumulate income. I assume the main reason is it provides a vehicle to keep donors anonymous and provides more of an official stamp.

It is possible for a nonprofit to get chartered by a state and not seek IRS approval. If I were to start a Tea Party group, I would attempt to avoid the IRS at all costs just on principle.

I agree. I have done several applications and would be totally surprised if there were no questions after applying. I have never processed a tax exemption without responding to additional questions no matter how complete the submission. The nature of the questions are usually structured in a way to get the non-profit accountable at the outset by clarifying the intended mission. In fact, when I first heard about this issue months ago I assumed the complainers were objecting to the normal process that all non-profits go through. Most people think the normal questions are overreach.

However, after hearing some of the requests currently published I cannot see a reasonable reason for them. There is a huge difference between asking the organizers "what will you teach?" than "what have you taught?". The first holds the organization accountable for its future actions. The second is not relevant and attempts to hold them accountable for their past actions.

This bears repeating...and should be picked up by our independent media. It shows how the left treats Fox News, talk radio, etc. It shows why a black or Hispanic or female conservative must be vilified and destroyed. All of the above work against their agenda and therefore are illegitimate. A black conservative isn't black, they are a conservative and abandoned their race. A female conservative is not treated with any respect because they are no longer considered a woman to be protected and respected once they speak out against liberalism.

Yet the Grand Old Stupid Party re-districted Florida in a way that ensured this asshat could be returned to congress while Allen West was dumped. Why!?! Because the GOP doesn’t want any of those whacky, racist Tea Party types in congress. The GOP-E actively seeks to sabotage the Tea Party. Hmmmm.
