I think some smart lawyer can make a case under "equal protection". Well, the defense certainly has a strong case for selective prosecution and the SCOTUS ruling that fetuses are not a human being.

In her writings, Susan B. Anthony occasionally mentioned abortion. Susan B. Anthony opposed abortion which at the time was an unsafe medical procedure for women, endangering their health and life. She blamed men, laws and the "double standard" for driving women to abortion because they had no other options. ("When a woman destroys the life of her unborn child, it is a sign that, by education or circumstances, she has been greatly wronged." 1869) She believed, as did many of the feminists of her era, that only the achievement of women's equality and freedom would end the need for abortion. Anthony used her anti-abortion writings as yet another argument for women's rights.

Some pro-life activists promote the idea that she was anti-abortion and would support the pro-life side of the modern debate over the issue. Unborn Victims of Violence Act of 2004 is the federal statute that he is being prosecuted under. Basically, if you commit a federal crime that results in the death of a fetus, you can be charged with felony murder. Many states also have similar statutes. It is a natural extension of standard felony murder statutes.
The originating federal felony was the product tampering of relabeling a medication, which is a nasty crime in and of itself.

Yes it is a federal crime, but I believe he is being prosecuted by the military under military law and I don’t know if they have a similar statute on their books.

These murder weapons are not like guns, which can be used for peaceful, legitimate purposes. They are designed solely to kill innocents. There is a word in the English language for such things: poison.

There are a number of federal crimes which carry the death penalty. But, I’m guessing this one is associated with the so-called “Lacey Peterson law” signed in 2005 by GW Bush.

It’s called the Susan B. Anthony Foundation.
