Some critics have pointed to New York States new gun control law as chilling in its scope and intent.
But new allegations coming from sheriffs may add to the outcry, as some authorities maintain that Gov. Andrew Cuomo pushed local sheriffs to stop publicly speaking out against the SAFE Act, the gun-control law he signed in January.
One source, in fact, told a local outlet that the governor threatened sheriffs jobs if they dont comply. Law enforcement officials were reportedly summonsed to Albany last month, where they met with the governor about the contentious issue. Its no secret that sheriffs have come out to publicly oppose the law, sharing their concerns with the public at large. But during the meeting at the capitol, Cuomo allegedly asked them to stop being so vocal.
The governor was of the opinion that the sheriffs around the state should not be interjecting their personal opinions in reference to the law, Chemung County Sheriff Christopher Moss told the Times Union.
Cuomos comments to authorities, though, about not publicly speaking out against the bill may have crossed beyond simply recommending silence at least according to one anonymous source. The Times Union has more:
One person briefed on the meeting said Cuomo threatened to remove sheriffs from office, a little-used power afforded the states chief executive under the state constitution. Moss would not confirm this. He did say the meeting was heated at times, but overall he described it as cordial.
[Sheriffs' Association Executive Director Peter] Kehoe did not return calls, and Cuomo spokesman Rich Azzopardi declined to comment. An administration official, speaking anonymously because he was not authorized to discuss a private meeting, strongly denied Cuomo had threatened to remove any sheriff.

That was my first thought - the governor has no say in whether a sheriff is in office or not.

Then NYS needs a referrendum on recall (at the governers office)
so that NY state citizens Consititutional rights are not trampeled further

Let’s see if he has the nerve to remove elected Sherriff’s.

Someone sent me a legal quote indicating the governor can relieve a sheriff of his post. But, they have an army, so to speak. So, in practical terms that may not happen. It will be interesting to watch. Expect popcorn sales to spin out of sight.

In reading about the “Sheriff” in these United (divided) States here recently, I made a personal commitment to research exactly what the difference between a “sheriff” and any other locally elected official is, but I suspect they are more autonomous and bulletproof than most when it comes to interference from either state and/or federal interfering. I have not done this yet, but I plan to.
Regardless, a pompous NY governor doesn’t seem to me as having much rightful (a key word here) over an elected county (or equivalent) “sheriff”.
The sheriff could call out the militia
I doubt this governor would do it. Blathering for his NYC, Buffalo and other Urban majority denizens. They, in those places, don’t have any guns!

The state militia reports to the governor. (Or, it did. I understand that Obama can seize any state’s militia.)
Depends on the specific laws of the state. IF...IF the governor of NY has, by law, that power over the sheriffs or not.
Would the Sheriff call a posse of county Citizens? Then what?

Sheriffs in New York State (outside of New York City, Nassau and Westchester Counties) are elected for three or four-year terms, depending on the vote of the county government, specifically the county legislature. The Sheriff of New York City is appointed by the mayor (see below) and the Sheriffs of Nassau County and Westchester County are appointed by the county executives of those respective counties.

If a Sheriff is ELECTED ( as they are in most of New York State, except NYC), how can Cuomo fire him?
He does not have the power to do so.
Methinks Cuomo is like Bloomberg - a tyrant that is used to getting his way.
