They stole 60,000,000 medical records – And won’t give them back.
Last week news broke that the IRS was facing a class action lawsuit over allegations that it improperly accessed and stole the health records of some 10 million Americans, including medical records of all California state judges. In a case involving solely a tax matter involving a former employee of the company, these agents stole more than 60,000,000 medical records of more than 10,000,000 Americans, including at least 1,000,000 Californians. The lawsuit by John Doe Company against 15 John Doe IRS agents is seeking punitive damages for constitutional violations, as well as $25,000 “per violation per individual” in compensatory damages.
But the story does not end there. The IRS to this day is refusing to return the records including intimate medical records to the company. Courthouse News reported:
Even though defendants knew that the records they were seizing were not included within the scope of the search warrant, the defendants nonetheless searched and seized the records without making any attempt to segregate the files from those that could possibly be related to the search warrant. In fact, no effort was made at all to even try maintaining the illusion of legitimacy and legality.
After being put on notice of the illicit seizure, the IRS agents refused to return the records, continued to keep the records for the prying eyes of IRS peeping toms, and keep the records to this very day. The records may concern the intimate medical records of every state judge in California, every state court employee in California, leading and politically controversial members of the Screen Actors Guild and the Directors Guild, and prominent citizens in the world of entertainment, business and government, from all walks of life…

I’d pursue that as a HIPPA violation.
The real story here is that our new insurgent government doesn’t care what the laws are even when it’s exposed that what they did was illegal. “The law is irrelevant” they say, and without shame.
Well now, I notice that prominent people in Entertainment are mentioned, Judges, etc.
What I want to know is are these records conservative types or useful idiot types?
HIPAA was Clinton’s contribution to this whole confidentiality charade and the start to this whole healthcare mess. Reportedly some Judges’ records are involved in this most recent theft. I do believe Kaiser was mentioned as the company involved. If it moves far enough up the food chain from we little people maybe something will be done.
OTOH I’m sure BO will take care of all of this the next time he goes to California for a fundraiser including bringing back copies of the electronic records with a note saying all the original information was destroyed and he will make sure it doesn’t happen again. /s/

HIPPA like EMTALA and any number of other Federal Diktats do not apply to the Federal Government.
Since the records are probably digital, “giving them back” is meaningless.
Prosecute and hang.

Democrats are the problem and the enemy of the individual
Congress has the power and authority to completely abolish the Tax Courts and force IRS cases into the regular justice system.
That is only one of many things that need to happen ASAP.

HIPAA is nothing but a paper tiger that has cost our health care system BILLIONS and MEANS NOTHING. It just means your medical records are between me, thee, and EVERYONE IN THE FEDERAL GOVERNMENT. Maybe folks will finally understand!!

Sorry, those same people who let the IRS off on the Tea Party investigation will be the same people who are too stuipid to figure out what this really means for them. After all, their saviour, obama, would never do anything to hurt them. They just want and need the free stuff.
