They stole 60,000,000 medical records – And won’t give them back.
Last week news broke that the IRS was facing a class action lawsuit over allegations that it improperly accessed and stole the health records of some 10 million Americans, including medical records of all California state judges. In a case involving solely a tax matter involving a former employee of the company, these agents stole more than 60,000,000 medical records of more than 10,000,000 Americans, including at least 1,000,000 Californians. The lawsuit by John Doe Company against 15 John Doe IRS agents is seeking punitive damages for constitutional violations, as well as $25,000 “per violation per individual” in compensatory damages.
But the story does not end there. The IRS to this day is refusing to return the records including intimate medical records to the company. Courthouse News reported:
Even though defendants knew that the records they were seizing were not included within the scope of the search warrant, the defendants nonetheless searched and seized the records without making any attempt to segregate the files from those that could possibly be related to the search warrant. In fact, no effort was made at all to even try maintaining the illusion of legitimacy and legality.
After being put on notice of the illicit seizure, the IRS agents refused to return the records, continued to keep the records for the prying eyes of IRS peeping toms, and keep the records to this very day. The records may concern the intimate medical records of every state judge in California, every state court employee in California, leading and politically controversial members of the Screen Actors Guild and the Directors Guild, and prominent citizens in the world of entertainment, business and government, from all walks of life…

When the DOJ and the US Attorney’s are corrupt, when any corrective action will be collective and not against individual violators, when the government happily will spend your money to defend against you for years, everyone has to ask if the solution can come from within the system.
Duh! Get an indictment, issue an arrest warrant and send in your SWAT team to arrest the IRS criminals.
They called it Gestapo and KGB respectively. We call it DHS but they all act tyrannical.

This is why I use facebook, even though some on this site would advise against it. I repost articles like this. It is probably the ONLY source of conservative news that most of the liberals on my “friends” list will ever see. Almost all young liberals use facebook, so we FReepers could make a big difference if we used these social networking sites as a method to spread our side of the news.

We will be written about in the history books, should the new Fascist American Government be defeated. They will chronicle the oppressions and outright lawless behavior of the American agencies in the early stages. They will chronicle the use of assassination drones to take out any conservative leaders. They will chronicle the intimidation, then outright seizure, of the press. They will chronicle the millions upon millions who are denied healthcare because of political leanings. When the food shortages hit, and the American agencies seize control of food, they will chronicle the mass-starvation of those people who's political persuasion or skin color (white) are not currently popular.

Too funny. That kind of stuff always happens to me too.
I work in Federal government, and I am here to tell you that HIPAA (and PII... Personally Indentifying Information) are very severely restricted and regulated. Encryption is always used at the database level, so that only authorized individuals in that government can view it, and you must have a very good and justified reason. Generally, requests for access are always reviewed with great skepticism.
Now, that is not to say that a corrupt leader or highlevel person cannot cause great damage to the population by ordering access (without the similar skeptical review) and abusing that access....
Ewww. Ick. If I were an IRS agent I'm not sure I'd want to stumble across those records by accident while having my morning coffee and danish.
If the number is 60,000,000 then it has to be Kaiser.
I worked for an elected official a few years ago and while we were touring one of their new facilities they proudly showed how any one of their doctors in any corner of the country could access someone’s medical records from any one of their computers, explaining that if someone were in an accident on vacation somewhere how useful all that would be. I shuddered and thanked God that I’m not a Kaiser patient.
So.....we all need to report our medical information to the FEDERAL government.... BUT it’s “encrypted,” only “authorized” people will look at it, and then under only VERY STRICT conditions.... so, remind me, WHY does the information need to be reported to begin with? Sounds like not much use is being made of it....except POLITICAL use. And, we have set up third-party payment programs that just invite fraud.
Well, not sure about this side of the Federal world (the IRS) but I do know the CDC uses HIPAA-sensitive information to discover trends, risk-factors, and possible preventions and cures for disease.
No offense, but it would build your credibility to spell it right: HIPAA.
Second, I work a lot with HIPAA-sensitive (and PII) information in a Federal role, and I have never heard that Federal agencies do not have to comply with HIPAA. In fact, they are paying me quite a tidy some of money to make sure that the websites I am tasked with, comply.
