As I've mentioned in related threads, when activist Justice Roberts referenced Gibbons v. Ogden to help justify his PC approval of Obamacare, he "overlooked" that the Gibbons opinion clarified the following about Congress's lack of constitutonal authority to address healthcare issues. Not only have the states never delegated to Congress the specific power to regulate healthcare, but Congress is also prohibited from laying taxes in the name of state power issues - such as healthcare.
"State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress (emphases added)." --Gibbons v. Ogden, 1824.

"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." --Justice John Marshall, Gibbons v. Ogden, 1824.

And given Justice John Marshall's clarification of Congress's limited power to lay taxes, it can be argued that the states should accept Obamacare funds to help recover state revenues which were stolen from the states by corrupt Congress laying constitutionally indefensible taxes.
