Bombshell: News Corp. says it has no record of DOJ notification of Rosen subpoena

News Corporation said on Sunday that it had no record of being notified by the Justice Department nearly three years ago of a subpoena for the telephone records of a reporter at its Fox News cable channel [James Rosen].

The company’s chief legal counsel at the time also said that he had never seen material from the government related to the subpoena.



Lawrence A. Jacobs, who was News Corporation’s chief legal officer until he left in June 2011, said he never saw a notification about the phone records.

“I would have remembered getting a fax from the Justice Department,” Mr. Jacobs said in an interview Sunday. “These are not the kinds of things that happen every day.”

It’s a mess alright. Some FoxNews official stated they had rec’d notice. This was yesterday.

Somebody might be introducing reasonable doubt for the DOJ. Or News Corp is lying. Or the FoxNews official from Saturday is lying....

A huge mess!

I though DOJ had already explained that they had to keep the warrant secret because it involved not only past communications but also potentially years of future communications.

Why would the notify Fox?

That’s my recollection as well. They got a judge to allow them to withhold the normal notification.

If so then there’s no story here. If not then it’s a big deal.

That’s why important document are sent certified mail returned receipt requested. Unless they have a signature from a FOX emplyee of substance there is no proof in a court of law that it was ever sent

No documentation. No proof

Wonder if Rosen was just a way for the DOJ to monitor the phones of ALL Fox employees and the Rosen request was only a cover.

There are records at Fox and at Justice if notice was sent. I believe that the notice to Fox is in the same drawer as the Holder recusal letter. That would be the drawer where Holder keeps his blank stationary, because at this point neither one exists.

I hope they do a better job on this than the forgery they id on the long form.

I think it was Judge Lamberth. But I’m not sure if he signed the original order. In fact I’m pretty sure he didn’t. He overruled the judge who signed it and allowed Justice to withhold the Rosen notification.

I read it yesterday out of the NY Times. Thread below:

On Saturday, a Fox News executive said that the notice had gone to News Corp., its parent company, on Aug. 27, 2010, but that Fox News was not told until Friday. The executive said they were still trying to sort out how the notice fell through the cracks.

Unnamed source at Fox, naturally.
