News Corp. Says It Was Not Told of Subpoena for Reporterís Phone Records

News Corporation said on Sunday that it had no record of being notified by the Justice Department nearly three years ago of a subpoena for the telephone records of a reporter at its Fox News cable channel.

The company’s chief legal counsel at the time also said that he had never seen material from the government related to the subpoena.

The Justice Department has signaled that it notified News Corporation on Aug. 27, 2010, that it had seized the phone records of a Fox News reporter — who turned out to be the Washington correspondent James Rosen — after one of his articles had included details of a secret United States report on North Korea.

“While we don’t take issue with the D.O.J.’s account that they sent a notice to News Corp., we do not have a record of ever having received it,” Nathaniel Brown, the spokesman, said.

Lawrence A. Jacobs, who was News Corporation’s chief legal officer until he left in June 2011, said he never saw a notification about the phone records.

“I would have remembered getting a fax from the Justice Department,” Mr. Jacobs said in an interview Sunday. “These are not the kinds of things that happen every day.”

He added, “The first thing I would’ve done would be to call Roger Ailes.”

News Corporation said it had conducted a thorough search of its legal records, including, Mr. Jacobs said, a scan of his e-mails and other relevant materials, and has found nothing related to the investigation. “The inference that I sat on this and didn’t share it with Roger couldn’t be further from the truth,” Mr. Jacobs said.

“A version of this article appeared in print on May 27, 2013, on page B3 of the New York edition with the headline: News Corp. Says It Was Not Told of Subpoena for Reporter’s Phone Records.”

It was linked on the front page down low in the e-NYTimes, but is buried on B3 in the print edition...

Hey, it says “the Justice Department signaled that (it had informed News Corp).” Maybe they used smoke signals and they just blew away.

Disgusting. The Times can’t even bring itself to say that Holder was lying about his lying.

I remember a few years back, while managing a department in a large corporation, being told to buy some totally unnecessary walk through curtains for a conference room in order to minimize eye injuries. I dutifully sent a note to our purchasing clerk telling her to order them. I then verbally told her to ignore the note. I commented that I was willing to accept criticism that my organization was incompetent, over criticism that my organization wasted resources. No one ever noticed that the curtains were never installed. In fact, a nearby area received so much derision for installing such curtains that they immediately removed them.

The same could be true of Holder. An order to notify Fox, ordered with a "wink-wink", was never delivered.

The unidentified source later confirmed that, “we also provided a certified copy of President Obama’s birth certificate.”

It appears that forger was having a buy 3 get one free special on fake “official” documents at the time.

I am just kidding...

That means they have signed receipts from Fox. So it is easy, DOJ. Produce the receipts signed by the Fox official.

“A law enforcement official said on Sunday that in the investigation that led to the indictment of Mr. Kim, ‘the government issued subpoenas for toll records for five phone numbers associated with the media.’ This person, who spoke on the condition of anonymity, added, ‘Consistent with Department of Justice policies and procedures, the government provided notification of those subpoenas nearly three years ago by certified mail, facsimile and e-mail.’”

The law required Holder’s DOJ to make the above notification to News Corp. News Corp says they never got it.

If NEWSCORP had gotten a fax from the DOJ telling them that one of their reporters phones were being tapped they would have been screaming it from the highest mountain. Why you ask? Because that is big news.

Thanks - so it wasn't law though - it was DOJ policies and procedures.

If FOX really wasn't notified, at a minimum this shows dishonesty and false testimony.

I can't wait to get America back.

If they sent it by certified mail they should have the green card receipt documenting this.

Ooooo! Looks like Barry and Holder really PO’d the NY Times by cutting off all of their leakers on whom they rely to generate sales. None of their sources “familiar with the matter but speaking anonymously because the matter is classified” know whether they have already been outed by secret warrants like the AP and Fox warrants.
