An Oregon man has had rifle confiscated and is facing criminal charges after he attempted to stop a wanted felon from breaking into his home by firing a warning shot.
Police in Medford, Ore., say the incident occurred at around 11:30 p.m. on Sunday. Officers responded to an apartment complex in the area after receiving a disturbance call. During their investigation, cops heard a gun shot and a man running away toward the complexs parking lot.
Authorities say 40-year-old Jonathon Kinsella, a wanted felon, was attempting to flee the scene when he was arrested on outstanding warrants, including for burglary and assault.

Press charges? The warning shot might be a sane reason to question if he was reckless.
My problem with the guy is firing a warning shot - in an apartment building(!).
For the sake of the other residents, I’d say the better option would have been to give a verbal warning - and then fire into the perps BODY, if he continued to advance, thus lessening the chance of of an innocent being hurt or killed.

You either need to stop the threat or you don’t.
An AR-15 is a VERY poor weapon choice for Household/Apartment defense. A 12 Guage pump w/ 00 buck is a MUCH better choice. AND NEVER fire “warning” shots SHOOT TO KILL if you are FORCED to shoot. Remember “It is BETTER to be tried by 12 than carried by 6”!
No, wouldn't stop a round, but it'd slow it down a lot, and deflect it.
Another way of putting it is
either the threat is worthy of stopping
or it is not.
Residence was an "apartment complex", from the article and looking at a picture. Perhaps they guy was on the ground floor:

The cops will say that if you are only firing a warning shot you are not fearful of serious injury or death. He should have never admitted firing a warning shot.

I don’t agree with the practice of giving a warning shot (especially in an apartment!).
However, the tendency of the police to confiscate is rather concerning.

I disagree. The AR15 is an excellent chooice for household defense, if you are going to use a long gun.
It has excellent intimidation value, holds plenty of ammunition, is far less likely to overpenetrate than buckshot if proper loads are selected, has less recoil and is much easier to shoot accurately.
The major problem with it is muzzle blast, which is one reason we need to remove the legal and financial barriers to effective suppressors.
Should've used a shotgun, then he could use the Biden Defense.

And yet, in 1934, there was an attempt to ban handguns in the US as many in Congress felt a RIFLE was a better defense weapon.
The NRA put the kebosh on that stupid idea.
If you're into warning shots better tell them you tried but missed.
If you have an intruder, do all of this that time permits:
1. Dial 911, say there’s an intruder and you think he’s going to kill you, and that you are preparing to defend yourself. Set the phone down carefully. If you have a second phone, such as a cell phone, and you have a lawyer, call his number, and set the phone down. Doesn’t matter if you get voicemail; in fact, that’s kind of the idea.
2. If applicable, place the selector level on your locked and loaded weapon on “fire” as quietly as you can manage.
3. Use your familiarity with your home and any available light to get a good sight on your intruder. If you can remotely turn on lights in his location without revealing yourself, do it.
4. The first shot he hears should be the first and last thing he hears inside your house.
5. Keep firing until you run your weapon dry or the remains have stopped twitching/wheezing. Feel free to start screaming like a little girl watching “Aliens” for the first time for the benefit of the phones. Do NOT articulate words.
5a. Maintain situational awareness for the presence of second or third intruder(s).
6. When you have secured the area, to include “stashing uninvolved weapons” (in the event of totally illegal but entirely likely search and seizure) go to the front yard and stand under a light. As police arrive, raise your hands so they are visibly up and empty before they exit their cars.
7. Say nothing to the police except your name, “I was in fear for my life”, and “I want a lawyer”, until that lawyer tells you different.
7a. Requests for beverages are acceptable.
I agree about ANY rifle in a highly populated area (as an apartment building). i don't like the idea of buckshot either. When I was living in an apartment, my 12 gauge load was #6 or #8. Guaranteed to mess someone up at close range (really bad), but reportedly would not penetrate 2 boards of drywall (insulation notwithstanding). Even at a longer range, getting peppered by those BBs would be a deterrent that the perp would remember...
Steel building frame construction is very dangerous.
If the building catches fire, the steel framing collapses at temps that wouldn’t affect wood framing much for 15 - 20 minutes.

I believe it was Jeff Cooper who said that when the cops come, “BE SHOOK! BE VERY SHOOK!” When they leave, “Break out the champagne!”
#4 shot will penetrate 6 layers of 5/8 rock no problem. keep that in mind. The best home defense weapon is the one you are most comfortable and familiar with. JMHO.
NEVER pull a gun unless you intend to use it and once pulled... USE IT! Anyway... the price of ammo now precludes any wasteful warning shots.
If this had happened in Arizona, the police would have been puzzled.
“You fired a warning shot? What’s that?”
“Did your rifle misfire? Why only one shot?”
“Let me get this straight. You had a clear field of fire at someone committing a serious felony, and you decided to run them off instead of shooting them. Do you realize you would be indirectly responsible for any future crimes he might have committed, plus now the taxpayers are going to have to provide for this individual’s health and welfare for the next 20 years? Are you anti-social?”
I value my weapons a whole lot more than I value a criminal’s life. If it’s worth shooting at all at today’s ammo prices, it’s worth shooting center-mass at the predator who disturbed my routine. I’m not going to risk losing an AR-15 just to save some criminal’s life. Besides, my favorite firearms instructor taught me about warning shots, “always fire three warning shots - two in the heart, and one in the head”.
an aimed shot into the dirt is also safe.
I’m agreed, 00 buck will put any intruder down and have low penetration and range.
I’d feel better about the guy if I knew he’d shot into the ground.
Of course there’s no guarantee theres not a big rock, or a chunk of concrete, etc. buried there.

I agree with you there too, I had read the story and the guy said he shot into the ground. As for myself, I’m with you, center of mass.

The police confiscate, the prosecutor demands surrender of the firearm in exchage for dropping charges and a promise not to sue. iow blackmail.
if the citizen wins the police play stupid in order to win enough time declare forfeture and “destroy” the item. (really they just keep it for themselves)
police training would have allowed the shot. The perp already demonstrated a risk of danger to the victim and the public at large.
With an AR, there should have been three very quickly sent rounds in the bleeding perp when the cops arrived. If you can ‘place’ one center mass, send three.

At the same time if you gotta’ shoot someone, and those ol’boys sometimes had the need, it’s best to not have any stray rounds zinging off into a neighbors apartment.

Last I heard you can still own a Thompson (semi-auto),
I had a customer in NM who had one beside his desk in his office. He carried a fully auto version during WWII. He was a great guy.
A Thompson is a heavy weapon. I was shocked when I lifted up one in the gun store. Much heavier than an AR-15 even WITHOUT a magazine.
The “warning” shot comes “after” your first shot puts down the perp.
While at a gun show I hefted both a Thompson and a MAC-10 in rifle configuration.
I found the MAC-10 better balanced and lighter. I did not get to fire them so can’t make a judgement on how they worked.
I did shoot an imitation Thompson, and while it would feed ammo by hand operating, I found it would jam if fired on every two or three rounds.
So is an M-1
