Posted on 06/06/2013 7:53:06 AM PDT by Student0165
A truck driver was beaten by a CHP cop because he refused to sign a traffic ticket before reading it. CHP initially charged him with DUI and driving over hours - both charges were later dropped.
Cops boss says citizens could avoid this if they will simply "comply" with orders when stopped.
Sorry - I thought the video link would post.
If you just do what they say, when they say, they won’t beat you. What a deal!! To protect and serve.
In Texas you are not required to sign the ticket. They ask but you can refuse. Your signature is merely an agreement to appear in court so if you don’t sign it only means they can/cannot file a Failure to Appear if you do/don’t.
It is an American Ethic not to comply with dictators.
F&^%$ them. I’m not taking orders from anyone.
In West Virginia back in the 1980's if you refused to sign the ticket, you were escorted straight to the closest courthouse and a magistrate either heard the case immediately or ordered you to appear on a certain date. I've heard the law has been changed so essentially it doesn't matter if you sign or not, the Officer just notes on the ticket that you refused to sign, but you are still legally bound to pay the ticket or dispute it in court.
Texas does give the officer the option of instander and taking you immediately to a judge. In my 14 years I only did that once. Just note they did not sign.
Kinda sounds like a wifebeater’s defense....
California über alles
über alles California
The case should be sent to the DA for prosecution of the officers.
I have to commend the two cops for one thing. They tried to say salt was an illegal drug but at least they didn’t plant any real drugs on this guy.
I watched the youtube video and it made me sick! Broken orbit, broken ribs, broken arm, concussion, knocked unconscious, possible neurological damage as a result of oxygen deprivation,... they almost beat him to death. I hope the man sues and before anyone jumps on me about taxpayers and such... I believe the police will continue to hire and protect these animals UNLESS it starts costing money. Money is the great motivator IMHO. When a police department has to answer for the payouts... they’ll change (or at least I hope so)
“When a police department has to answer for the payouts... theyll change”
Or the thug officers will learn to escalate their brutality and not leave any witnesses.
Just sayin !
Off you djuzt follow Der Rules Untermenschen, you vil NOT be Beat - !!hard.
This is so breathtakingly evil that words escape me. Andrew Murril belongs in the penitentiary with a horny cellmate who will teach him the meaning of brutality!
The spokesman for the disgraced CHP comes across as an ignorant and evasive fool.
Like most government agencies, the CHP needs a thorough housecleaning and a definite reduction in the number of cops. Too many cops with too much time on their hands and a violent streak a mile wide.
That’s the case in Florida. I expect it is in most states.
Still, one is entitled to *read* it before signing. Although the few tickets I’ve gotten over many years were all completely illegible.
has anything happened to the officer and the police involved?
The tax payers are complicit if they indirectly hired and paid these thugs. Hit them in the pocket book until they scream for this stuff to stop.
Good thing he did not have a dog with him...
If the truck driver were a protected minority with the proper melanin content, cities would be burning by now...
Back in the day a girl who lived down the road from me and who would sleep with anything would have cops comimg and going all hours and they would let her brothers tear down the road at high speed.
I happened to be driving a car that I had just had an accident in 2 months before, it had flipped over. It wouldn’t go over 35 without shaking furiously. I had taken my son to the library and he got sick so I was taking him home. I was going the speed limit and stopped at a stop sign behind an officer. I came to my stop and proceeded and he immediately did a U-turn and stopped me. I asked him why he stopped me and he got snotty saying I was going 75 in a 20. I told him I was not and the car couldn’t go 75 if I begged it to. He pulled out his ticket book, took my registration and license and wrote me a ticket. I told him my son was ill and just give me the ticket so I can go. He said I could go when he said so.
He went to his car and was checking when I got a call from a friend who had a scanner. He heard the officer call it in and told me the cop had called me a bi*ch. When the cop came back to my car and told me to sign the ticket I said I was going to be a bi*ch and not sign. He got a strange look on his face and then he had an epiphany. I asked him how he liked the prostitute down the road from me and I said I had seen him many times and that I did not appreciate being called a bi*ch. I also told him he can shove the ticket where the sun don’t shine. He handed me the ticket. Before he walked away my son put his head out the window and threw-up nailing the cops pantleg. I looked at him and said “told you he was sick”. I’m surprised I wasn’t shot!
I went to court and he never showed up. The judge heard my side and asked me what I wanted to do. I told him I wanted to go home and he told me to have a nice day. :)
The cops don’t care about fines as they don’t pay them themselves. The law should be that any brutality case settlement should be paid out of the offending officers pocket. THAT would bring an end to this stuff. Until then the cops just laugh at us.
Is that worthy of commendation—whether or not they beat an innocent man within an inch of his life during the incident?
Kinda sad when two cops can’t control a much smaller guy without this level of force.
They probably could but my guess is they didnt even try.
Obey or we’ll break your arm. Heck he’s lucky they didnt shoot him.
Looks like the bastard is still at work, getting paid by taxpayer dollars, protected by a court appointed attorney paid by tax payer dollars, enjoying future benefits paid for with tax payer dollars while he is free to beat up or kill more taxpayers.
What is more frightening than this beast Murril, is his NAZI Gestapo Boss protecting and justifying his action.
The ENTIRE UNIT of cops operating out of that patrol headquarters should be fired.
This guy is old enough to have remembered living in the Soviet Union. I wonder how feels now that he realizes the Soviet Union is here?
And people wonder why some of us hate cops?
Yep, just be a good little peasant and you will be fine. Until they invent a reason to come break down your doors.
None of them got off scot free, and all of them would probably handle the same situation differently, knowing what they do now.
Sometimes it just isn't worth the brief momentary gratification if the result is a lifetime of misery. Every American citizen has a God-given right to show the authorities that they stand to gain nothing by misbehaving. Be sure to disincentivise bad police behavior, and eventually they'll stop once it's no longer fun to play that game.
You not only can fight City Hall, you are obligated to do so if you're an American. The truth is, you can kick the wheezing snot out of City Hall, as long as you do it one now-retired overweight swine at a time.
But the CHP’s internal investigation cleared the cop. Isn’t that enough? /sarc
Was there a dash cam video or was it conveniently out of order?
“If you just do what they say, when they say, they wont beat you. “
What if you’re Russian like this man, and don’t know English????/s;)
IIRC the state is exempt from law suits but the cops ar not. If you name the cop the state can refuse to idemnify them if they were acting in an extreme manner or outside the scope of their duties.
IMO these were acting inside the scope of their duties and the department will cover any award.
I believe punitive damages cannot be paid by the state.
The state can also discipline/fire the officers regardless of what happens in court.
The two should be on administrative leave while undergoing an internal affairs investigation. They are cearly a danger to the public.
My investigation experience ended in 98 when I retired.
Perhaps someone more recent could comment on Cal cases.
Well, technically if you don't sign, they can arrest you and take you in for booking. When you sign, you are promising to appear in court, so you are being released on your own recognizance. If you refuse to sign, you are essentially saying you may not show up in court, so they then have the option to book you and force you to post bond to insure that you show up.
“I went to court and he never showed up.”
Had this happen too. The only cops that show up are the ones ‘on the clock’ and getting paid for the time, that comes out of the time they would be on the street. If a cop is retired he would have to respond to the subpoena and accept the insulting payment.
The cop in our case has retired and was never served the subpoena. We were witnesses to the accident and had to drive an hour to this court under threats from the court if we didn’t show.
I contend one of the benefits to the ‘men of blue’ have their subpoenas lost once they retire. Just a courtesy of course.
Seven cops lost their jobs not long after this. We saw umpteen police cars at that girls house. They were being investigated for drugs and prostitution. She was arrested along with her mother and apparently she gave names. We laughed until we were to tired to laugh anymore. :)
Can’t we all just get along?
I was happy to go to court that day. I showed the judge my accident report and the damage done to myself and the car. I had 147 staples in my spine from surgery and would not have driven fast even if I could. I told the judge that the officer had called me a bi*ch and that I told the cop he can shove his ticket. The judge actually laughed at that and the fact that my son had thrown-up on him. The judge apologized and told me to go home and have a nice day.
I was not going to let this officer lie and get away with it.
Reminds me of a song.
“The way they pull you over it’s suspicious / Yeah, for something that just ain’t your fault / If you complain they’re gonna get vicious / Kick in the teeth and charge you with assault” American Ruse
As time passes and more and more government employees take up the socialist poison that is our government now, hiring and training decisions are made by statist criminals. The police are increasingly the muscle of the fascist state. ten or twenty years ago I was a big supporter of the police. My eyes are now open. I do not trust the police and I don’t recommend anyone else trust them either. When the SHTF, they will be the ones to drag you in.
That’s attempted murder.
I didn’t think the USA was that far along in its headlong rush to fascism.
Remember the “land of the free” bull$h!t? That’s all it is bull$h!t.
The cop looks like a SS agent.
I will not sing The National Anthem and won’t stand up for it because I no longer believe we are “the land of the free”.
Nor do I pledge allegiance to the State.
