Sober driver charged with DUI... even though he had a 0.000 blood-alcohol content [AZ]

An Ohio man was charged with DUI after her was pulled over by the police, despite the fact that a breathalyzer test showed he had a blood-alcohol content of 0.000.

64-year-old Jessie Thornton who now lives in Surprise, Arizona said cops told him that they could tell he was drunk simply by looking at him.

Surprise Police Department paperwork shows Thornton was 'pulled over for crossing the white line in his lane.'

'An officer walked up and he said ‘I can tell you’re driving DUI by looking in your eyes.’ I take my glasses off and he says, ‘You’ve got bloodshot eyes.’

Thornton said two other officers arrived and they conducted the sobriety test.

With a BAC of 0.000, the situation should have been resolved quickly, but Thornton was evaluated for possible drug use as well.

'Yes, I do the breathalyzer and it comes back zero, zero, zero,' said Mr Thornton.

While in custody, a 'DRE' or drug recognition expert is called in to test him.

'After he did all the tests, he says, 'I would never have arrested you, you show no signs of impairment.'

'I then get this message that my license is being suspended and I have to take some sort of drinking class or something,' he said.

Mr Thornton now claims that it wasn't DUI but motivated by race.

'It was driving while black,' he proclaimed. 'I just don't want any of this to happen to somebody else,' he said.

His latest incident with Surprise police officers prompted him to hire a lawyer with plans to sue the department for $500,000.

I guess that 0% BAC readings don't fill the municipal coffers, so they had charge him with something.

I just got over pink eye. I guess the Surprise PD could have arrested me too. Not only should the city be sued but the officers and their supervisors should be held PERSONALLY responsible.

He was clearly in the wrong.

When confronted by a highway stormtrooper traffic cop, always admit you did whatever he said you did even if you didn't. hose are the new rules. Government always right, citizen subject always wrong.

It's good enough for doctors, lawyers, nurses, pharmacists, etc., but evidently not good enough for cops.

One can have a BAC of 0.0000000 and still be “impaired” and,thus,legally unfit to drive.For example,I have diabetes.My blood sugars seem to swing pretty substantially and,as a result,I can get very sleepy...even in the middle of the day and even when I'm under the influence of *nothing* that effects one’s brain.I don't know if this is the case here but physicians...and probably some diabetes patients...can confirm what I've said about *my* situation.

I don’t care for the “racist” angle, but I’ve been through hip replacements, and you don’t do it if you don’t hurt like Hell. I hope he gets the half-million. And I’d like to see the officer see some punishment, but that won’t happen.

It wasn’t motivated by race. The DUI laws have become a neoprohibitionist movement and a moneymaker for politiicans, MADD, the courts, the county, lawyers, and the insurance racket.

Blowing below 0.08 does not free you of being charged. Blowing above it only makes it easier for them to convict you.

Now engage in some carnival games of balance and memory and we’ll see how much we can shake out of you.

The other thing that’s at work is the tendency for cops to double down once they’ve f’ed up. They do something wrong, you demonstrate that they’re wrong and they’re still going to charge you to keep you quiet.
