BMW hit with discrimination lawsuit from EEOC

The U.S. Equal Employment Opportunity Commission announced a lawsuit against BMW on Tuesday, alleging that one of its facilities in South Carolina adopted a criminal background check policy that led to a disproportionate impact on African-Americans.

According to the EEOC, BMW switched contractors at its South Carolina plant in 2008 and instructed employees of the old contractor who had been working at the site to reapply with the new firm. This new firm was instructed to conduct fresh criminal background checks on all applicants.

...The result was that out of 645 experienced employees, 88 were denied rehire, including 70 blacks, the commission claims. That means 80% of those turned away were black, despite blacks constituting only 55% of employees.

In a separate case announced Tuesday, the EEOC filed a nationwide lawsuit against Dollar General (DG, Fortune 500) based on its policy of conditioning job offers on criminal background checks. This policy, the commission said, "results in a disparate impact against blacks."

Dollar General said it will "vigorously defend" against the suit.

If the rules were equally applied, there is no case. Otherwise, BMW will pay.

Sounds like a destined-to-fail lawsuit intended to gin-up turnout and contributions from the key Obama voting bloc.

55% of the employees at the plant were black? Seems to me BMW ought to get a commendation for hiring MORE than the population entails....

According to the Obama Census Ministry:

blacks only make up 28% of the population of South Carolina, which means BMW had an OVER-REPRESENTATION of black employees.

Reminds me of the joke about the employer being told by gov’ment that 15% of his employees must be black so he fired several blacks. When questioned, he said that he was way over the 15% edict so he was meeting the requirements.

Well, Duh! Maybe if they did not commit crimes disproportionately to their representation in the population there would be no problem! Again the law abiding are supposed to bend over for criminals because of racial background. What incentive is there for obeying the law? Damned if you do and rewarded if you don’t.

Good grief. An employer is hit with a discrimination lawsuit SOLELY because blacks disproportionately commit crimes, which result in 'disproportionate' criminal records?!
