The U.S. Equal Employment Opportunity Commission announced a lawsuit against BMW on Tuesday, alleging that one of its facilities in South Carolina adopted a criminal background check policy that led to a disproportionate impact on African-Americans.
According to the EEOC, BMW switched contractors at its South Carolina plant in 2008 and instructed employees of the old contractor who had been working at the site to reapply with the new firm. This new firm was instructed to conduct fresh criminal background checks on all applicants.
...The result was that out of 645 experienced employees, 88 were denied rehire, including 70 blacks, the commission claims. That means 80% of those turned away were black, despite blacks constituting only 55% of employees.

Dollar General said it will "vigorously defend" against the suit.
If the rules were equally applied, there is no case. Otherwise, BMW will pay.
Sounds like a destined-to-fail lawsuit intended to gin-up turnout and contributions from the key Obama voting bloc.
oh....and BMW, Thanks for choosing South Carolina over Mexicali! /sarc
55% of the employees at the plant were black? Seems to me BMW ought to get a commendation for hiring MORE than the population entails....
According to the Obama Census Ministry:
blacks only make up 28% of the population of South Carolina, which means BMW had an OVER-REPRESENTATION of black employees.
“...despite blacks constituting only 55% of employees.”
55%!!!!! Looks to me like that other races need to be filing discrimination claims.
Non union plant, isn’t it.
My car came from there.
Elephant in the room—The fact that criminal background check policies have a disproportionate impact on African-Americans.
Maybe if African-Americans obeyed the law. . .
Effing fascist government!
Reminds me of the joke about the employer being told by gov’ment that 15% of his employees must be black so he fired several blacks. When questioned, he said that he was way over the 15% edict so he was meeting the requirements.
“Statistically, blacks and Latinos face criminal convictions at a rate disproportionately greater than their representation in the population.”
Well, Duh! Maybe if they did not commit crimes disproportionately to their representation in the population there would be no problem! Again the law abiding are supposed to bend over for criminals because of racial background. What incentive is there for obeying the law? Damned if you do and rewarded if you don’t.
I must be on the wrong planet. Beam me up Scotty!
What kind of impact do laws have then?
What about the “marginalized” crackers in the NBA? Let’s send a pile of AA’s packing to we can even up the discrimination there.
Non-union plant; Obama's EEOC attack dogs are suing. That CAN'T be a coincidence.
BTW, you citizens of South Carolina, how's that booming economy with that new Boeing assembly plant you didn't get thanks to Obama. You guys should be really p*ssed!
Elephant in the roomThe fact that criminal background check policies have a disproportionate impact on African-Americans.
So-called "social justice" is to justice as social diseases are to the common cold.
This is nothing more than the Federal Government forcing companies to hire black criminals.
We are a mini South Africa with Obama in the White House.
A white heterosexual male Christian is in trouble.
19.7% of the Blacks were denied re-hire due to criminal records vs. 6% of non-blacks.
Sounds about right.
“Criminal background check”??? OMG!!! How DARE they! /s
These convicts were using up jobs that could have gone to deserving Unregistered Democrats.
So true. We live in Florida. I may buy another car made from a non union plant when this one needs replacing. I try to do right on things I believe in but it's hard to with so much crap going on in all businesses with this unpatriotic ruler.
They've gotta prove that a black with a particular record was turned down when a white with an identical record was hired.*That* could well be discrimination.Without such proof....no discrimination.
Accidental admission by big brother that a higher percentage of blacks are criminals.
The last UAW made car I bought was in 1990.And that's due to a specific decision I made...UAW=Communist=not for me,thanks.
So now it’s racist to make sure you’re not employing a violent ex-con?
Welcome to Obama’s America, where freedom is slavery, war is peace and ignorance is strength
Well, they should not have committed a "disproportionate" amount of the crimes.......
Get one of those bumper stickers that says:
I’m not Driving While Black, I’m Black While Driving!.......
One of the big problems with these plants is tools and parts growing feet and walking out of the plant. A prior criminal record is one way to screen new employees to avoid theft.
In spite of their screening they still managed to find plenty of disadvantaged minorities to hire..so they should be give a medal..not a law suit.
I guess I make a special effort to shop at DG.
This is a shakedown, nothing more........just wait and see.......
When will the EEOC enforce strict quotas on the NBA based on population?
I drive a Lincoln Town Car. With the factory tint they can’t tell what color I am. They just know I’m old.................
If pro sports had the same criminal background criteria, they’d have to dismiss a significant percentage of their employees.
2003 Lincoln Town Car Executive.......smooth ride............
It would seem that if BMW fired all of their non-black employees at the same time using the same criteria, no prejudicial behavior could be proved.
Agreed. The Feds recently settled a case in Minnesota over disparate impact. They know it won’t survive first contact with SCOTUS. Only good as a tool for the Jesse Jackson Hustle.
They put out a discussion idea about not asking about backgrounds until the second or third interview, and if a candidate has a background to take a solid look "one more time" before deciding against a particilar candidate.
They've been salivating to get their hands on a disparate impact case caused by background checks.
I loathe the EEOC.
Lol, I am not old enough to drive one of those!
Obama’s been gunning for this freedom of association aspect of the First Amendment, insofar it involves hiring among other associating, for some time.
Just toss it among the Amendments to the Constitution his administration has already shredded.
The EEOC admits that Blacks are Criminals
I hope both companies fight this Black Racism. Black community needs to be held accountable and responsible....not honest folks
” not asking about backgrounds until the second or third interview, and if a candidate has a background to take a solid look “one more time” before deciding against a particilar candidate. “
Interviews are all about eliminating the unsuitable candidates as early as possible. I think that most ex-con’s will fall into the category of one interview only. Can you deliver appliances to people’s homes or not? The most important thing about hiring this guy, is not accepting somebody who will endanger your customers and result in a lawsuit. In a book on how to not be a victim a former robber said, “My job was to deliver stuff. I’d ask to use your bathroom and then unlock a window.”
FWIW, I notice that people tend to get the hell out of your way!......................
this is the jessie jackson shakedown crowd.
This is to force them to use certain “favored” (crony) bond and consulting firms.
I hope they fight and break the back of these litigation bullies.
Also it is probably supported by unionista thugs.
Haven't you noticed that the NBA balances out with the cheerleaders?
I stand cor-REC-ted!
I like Fords and have even owned two Lincolns, but the Lincolns have REALLY given me problems. I don’t know if I’ll ever get another Lincoln.
So does pre-employment, random and post-accident drug testing also discriminate against “people of color” disproportionately, too, then? Maybe they should file a suit against the insurers who mandate and the companies who implement such policies, as they just can’t say no to drugs (and crime)and that makes it racist to fire them. (/s)
