EXCLUSIVE: Stop-and-frisk lawsuit may lead to federal monitor for NYPD

Attorney General Eric Holder's office has filed a brief seeking a federal NYPD monitor in the event the court finds the stop-and-frisk policy unconstitutional.

IN A STUNNING MOVE sure to send daggers through 1 Police Plaza and City Hall, U.S. Attorney General Eric Holder weighed in at the last minute on the federal stop-and-frisk trial, tossing his support behind a federal monitor for the NYPD.

Disputing outright the objections of Police Commissioner Raymond Kelly and City Hall, Holder’s office filed an eleventh-hour brief that could lead to a monitor if the NYPD’s stop-and-frisk policy is deemed unconstitutional.

The last day to file legal briefs in the case was Wednesday — and Holder’s office dropped its bomb shortly before midnight, making good on an earlier vow to get involved in the controversial issue.

The Justice Department declined to weigh in on the question of whether stop-and-frisk is constitutional. But it staked out a clear position in the debate over what should happen if the city loses the civil rights case. “It is the position of the United States that, should the court find that the NYPD’s stop-and-frisk practices are unlawful, the court has wide discretion to enter injunctive relief,” the strongly worded “Statement of Interest of the United States” declares.

“The injunctive relief may include the appointment of an independent monitor.”

Manhattan Federal Judge Shira Scheindlin, who is deciding the class-action suit, would appoint the monitor. The naming of a monitor to oversee the stop-and-frisk program would be a slap in the face to Kelly and Mayor Bloomberg.

This is too rich. With all of news about the NSA data mining, the Leviathan pot is calling the Gotham kettle black on the Fourth Amendment for starters. It also now involves the Fourteenth Amendment, thanks to the feds. All the gun grabbers could care less about the Second Amendment. Preventing crime trumps the latter. Who knew?

NYPD better fight this monitor stuff....this is a nightmare for any police agency because the DOJ will lie and make stuff up so they can they dirty hands on your dept and strangle police work right out of your culture.....fight fight fight this NYPD!

I believe I kinda heard about this a while back...Is this in work already???

I could be visiting NYC (very unlikely to begin with, but hypothetically) and a NYPD goon could stop me on the sidewalk, ask me who I am, which I believe is legal to establish ID, and then conduct an unwarranted search of my person???

No probably cause, other than they decided to target me???

The whole issue of having a Fed monitor this activity is like haing a propane delivery driver fill your tank while you are BBQ-ing at the time...

The NYPD will stop you and proceed to run roughshod over your 4th A....all due to the fact that NY has a Black Crime avalanche and the NY Nazi’s refuse to profile the criminals.
Just stay away from the hellhole of NYC!

So let me see if I have this right, In Arizona if stopped for a traffic infraction it’s a civil rights violation to ask about legal status, but in NYC I can be stopped and frisked on a whim legally? It must be because NYC is liberal and liberals would never violate your civil rights, right? /s

I’m sure the net is being thrown far and wide on this sh!t...

But there are too few people with the guts to call it that in NYC...

I’d almost be more concerned about being NSA’d or IRS’d at this point, for speaking out against this crap...

But hey, this is your bed NY, you made it, you get to lay in it...What a shame...

Perhaps - but his move also puts a Fed as overseer of a local law enforcement entity - backing the Constitution or consolidating power? (Enquiring minds want to know)

A government takeover of cops? A Socialized/Nationalized police force just like Europe. Next they’ll position a Superintendent who reports to them. Healthcare they same. It looks like they’re standardizing the globe.

The reason for the lawsuit (other than the blatent unconstitutionality of the proceedure) is that something like 85% of the persons ‘stopped and frisked’ are black or hispanic.
