Eighth-Grader Who Refused to Remove NRA Shirt Could Face Year in Prison
National Review ^ | June 17, 2013 | Ian Tuttle

Posted on 06/17/2013 6:03:27 PM PDT by grundle

Perhaps a suddenly firearm-friendly President Obama can put in a good word for Jared Marcum. In April, Marcum, an eighth-grader at Logan Middle School in Logan, W. Va., was arrested when he refused to take off his NRA t-shirt. The New York Daily News reports:

The clothing kerfuffle began when Marcum wore a shirt bearing the NRA’s logo and a hunting rifle. As he stood in line in the cafeteria, a teacher ordered him to either change shirts or turn it inside out.

Marcum declined and was sent to the office, where an officer was dispatched after he again refused to comply with the school’s request.

Cops arrested him and charged him with disrupting the educational process and obstructing an officer.

Late last week Marcum “appeared before a judge and was officially charged with obstructing an officer,” reports Fox News. If convicted, he could face up to a $500 fine or a year in prison. He will be back in front of the judge on July 11 if his attorney cannot get the charge dismissed before then.

One can understand this sort of silliness across the border in Maryland (as we have chronicled here and here) — but in West Virginia? This is, after all, the state whose senator’s campaign ad featured him shooting Obama’s cap-and-trade bill. Ah, those were the days.

Direct the government spy agencies, including the IRS to look under his parents fingernails, bank accounts, school records, medical records and criminal records...

Find something in there and use it to harass, bankrupt, undermine, compromise and intimidate them.

If they trip, make damn sure they fall.

If the school had a policy of nothing to be written on any t-shirt worn by a student, then the kid was looking for trouble. If this were so, then I’m with the school except for the kind of punishment.

He was not charged with anything related to his shirt or his refusal to either change his shirt or turn it inside out. The young man instead was charged with, of all things, “obstructing an officer”, when he defended his right to wear it in front of the cop or agent of the government who showed up.

Logan County Schools’ dress code, which is posted on the school system’s website, prohibits clothing and accessories that display profanity, violence, discriminatory messages or sexually suggestive phrases. Clothing displaying advertisements for any alcohol, tobacco, or drug product also is prohibited.

The kid had better not plead guilty to any crime with a sentence of one year or more. Otherwise, he will lose the right to own any firearms for the rest of his life.

I feel sorry for you. Just read the rest of these comments and tell me that they are all wrong too. I can see being a Penn State fan, but to excuse JoPa's reprehensible behavior is pathetic. He either pretended he didn't know, or he was dumber than a rock, or he was complicit. Can't think of any other options for what he allowed to happen to these kids.

But now it's up to the Good Lord to deal with him . . . I hope he made his peace with God before he died.

No, his shirt was NOT in violation of the dress code.

Apparently, one government union individual was personally offended, so certain other related government union workers abused their limited authority on the school level, and called in still other elements of government union employees, who officially and openly abused their authority, under cover of law.

Notice a trend?
Union-government employees-abuse of limited authority?

He didn't violate the dress code, since a picture of a gun is obviously not "violence." His offenses were more along the lines of politically incorrect thoughtcrime.

“Where does it say “violation of this dress code punishable by PRISON?”

Of course, the kid was caught with a “secondary” violation because he refused to do something an officer instructed him to do. The whole thing is an exercise in poor judgement by the officials involved. If a student is deemed to have violated the school dress code and refuses to comply, the best way to handle it is to simply tell him/her that he must comply with the “rules” or be suspended from participation in school until he decides to comply. Same with refusal to comply with any other standard set by the school (which should have input by parents before adoption, but that’s another matter).

Then, the student (or his parents, or both) can appeal the suspension and get a hearing on the matter. There was absolutely no need to involve an “officer” and allow it to escalate this far.

No. Thoughtcrime is whatever the state's enforcers say it is.

Here's the dress code:

STUDENT DRESS CODE

The Logan County Board of Education believes that its major concern is the safety and well-being of the students of Logan County, and to provide every child with an appropriate environment for a thorough and efficient education.

Therefore, the development of a policy on dress code is for the protection of the health and safety of the students and to remove any distractions or obstacles from the daily educational process.

Since there is a direct relationship between dress and behavior, it is believed that students and staff should dress appropriately for the school setting.

Appropriate, will be defined here as right and correct for the school setting and functions, conducive to learning, and shall not distract from or be disruptive to the learning process.

Logan County School students should always be neat and clean in their dress and appearance. It is expected that each student will maintain a proper mode of dress, both during the school day and at all school activities. If in the judgment of the administration, a student is dressed inappropriately, the student will be required to change clothes or cover up inappropriate clothing before returning to classes. Time out of class will be regarded as unexcused. Additional measures may be taken if deemed necessary by the administration. The administration has the final authority on all matters relating to the dress code.

Dress Code

· Student dress and grooming should be in good taste and appropriate for the occasion.

· Sunglasses are not to be worn in the classroom unless a medical permit is on file.

· No hats or bandannas are to be worn in the building during the class day. If students must wear a hat to school, the hat must be placed in the locker and left there until the school day is over. Vocational students may take their hat at the time of their departure.

· Appropriate clothing should be worn at all times. The main torso of the body should not be visible. Therefore, the wearing of mesh shirts would be inappropriate without and appropriate shirt under the mesh shirt. The wearing of garments considered as tank tops or tops with spaghetti straps is inappropriate.

· Any article of clothing or accessories, such as jewelry with spikes, dog collars, wallet chains, chains worn as belts, that may cause injury to another student may not be worn at school or school functions.

· Clothing and accessories that display profanity, violence, discriminatory messages or sexually suggestive phrases are not to be worn at school or school functions.

· Clothing that displays advertisements for any alcohol, tobacco, or drug product is not to be worn at school or school functions.

· Waistband of shorts, slacks, skirts, and similar garments must be worn above the hips. If belts, suspenders, or straps are worn, they must be worn in place and fastened. Undergarments shall not be visible. Any article of clothing that is excessively torn may not be worn.

· Shoes must be worn at all times. Shoes with laces should be laced and tied at all times.

· Business-style blazers, suit coats, and ties are permitted but outdoor jackets and coats are not to be worn or carried to class.

· The legs of trousers and pants shall be worn down at all times.

· Hem lengths on dresses, skirts, and shorts must be no higher than mid thigh.

· Students who attend R.R. Willis Career Center must observe all safety program dress code requirements.
