Posted on 06/28/2013 8:54:43 AM PDT by jazusamo
House Oversight and Government Reform Committee Chairman Darrell E. Issa said Friday he believes the woman at the center of the IRS scandal waived her Fifth Amendment rights when she came before the committee last month.
I have considered the matter deliberately, including the opinion of Lois Lerners lawyers, Mr. Issa said,
Ms. Lerner, director of tax-exempt organizations for the IRS, began the witnesses testimony by denying that she acted improperly and then invoked her Fifth Amendment right against self-incrimination.
I have not done anything wrong. I have not broken any laws, she said. I have not violated any IRS rules or regulations, and I have not provided false information to this or any other congressional committee.
Mr. Issa dismissed Ms. Lerner from the witness table, but Rep. Trey Gowdy, South Carolina Republican, objected, saying that since she made a brief statement in her defense, that effectively waived her right to invoke the Fifth Amendment.

Since when does rule of law apply to liberals?
Issa should never have let her leave the room. He should have suspended the hearing to consult with attorneys and made her keep her lying ass in the chair until they got legal ruling.
Well, call her back and start asking questions.
For all the good it will do...
I hear you and it’s seldom, probably won’t in this matter either.
Thanks to Trey Gowdy for calling out the sham!
So they recall Lerner, and she again refuses to testify, and they hold her in contempt. Isn’t this just like Holder?
a short lived PR victory at best?
Elijah Cummings will pull every trick out of the hat to derail calling her back, IMO.
Have the Sargent-at-Arms arrest her, cuff her and frogmarch her out.
Or she just lies, and dares Issa to do anything about it.
Strike while the iron is hot
Strike when the iron is as cold as Nancy Pelosi's heart.
“Since when does rule of law apply to liberals?”
Prediction: Nothing will happen. Nothing to see here. Move along. Move along.
Reset II - it’s not only a good idea, it’s becoming the only idea.
Amen to that, a shame we don’t have many more like Trey Gowdy.

LERNER: Rep. Gowdy - Full Committee Business Meeting
The rule applies to every other COMMON CRIMINAL in America but NOT to this creep?
Howdy called it right away, Mr. Chairman...
Shoulda listened to him...
That’s Gowdy, you POS iPad.....
You really should watch those segments in the House Oversight Committee.
They brought up an amendment and a resolution. It was on c-span 2 so it may be replayed on tv at some time.
I could not watch all of it, but there was one congress member (a Democrat) who was calling out Issa for a “witch hunt”.
I’ll have to watch it again (didn’t catch it at the time) because I was not clear exactly what the outcome was of the amendment vote or the resolution vote.
Yup. Protecting criminals is what Democrats do best. BTW, they don’t want to get to the truth. If they poke around long enough, they might find connections to high level officials.
For cripes sake, Issa, get off the damned pot! You can’t let this string out like F&F. DO SOMETHING CONSTRUCTIVE
Weave me a cone yoo cupid bat.
(I think Dilbert's publisher is pretty aggressive about copyrights, so I didn't directly post the comic)
I’m not sure he will..especially after another IRS employee took the 5th..the public is pissed...
LOL!!! Nice to chuckle some today...thanks.
“Howdy called it right away”
Wrong approach. Give her immunity - go for the big fish.
What are they going to do, hold her in contempt and put her in jail? Only make everyone feel bad for her.
They won’t prosecute her. The key is to identify the folks in the White House who are obviously behind this. Give her immunity and she has no choice.
Get the House prison cell ready...she will not comply.
LMAO!!!!! Happens to me all the time! I thought you were just bein' folksy! ;-)
Wow.. I just got a great laugh out of that... thanks, fellow VA FReeper. How goes it?
Yep. you can bet if she’s called back she. Will assert the 5th.
Would be sumpin if she were held in contempt.
Not gonna happen.
Shoot her then, see if we get anything out of her when she is dead, effin’ narzi.
SHE TESTIFIED TO HER INNOCENCE then pleaded the 5th. You cannot pick and choose to testify then not testify. How is she allowed to get away with that? She waived her rights by testifying. Even a novice such as myself figured this one out. Has Issa been blackmailed now too? Lerner should be charged with ‘abuse of power’ at a minimum and we taxpayers should not be PAYING HER WHILE ON LEAVE.
Bye-bye 5th Amendment! Supreme Court Decides: Anything You Dont Say Can and Will Be Used Against You
In the first link at post #15 at 34:15 minutes Rep. Trey Gowdy speaks and rips Lerner for testifying after asserting the fifth.
It’s worth the 5+ minutes to watch, Gowdy is terrific.
you can invoke the fifth at anytime, to any question...
that is your right.
Statements a person makes under oath are subject to cross examination according to Trey Gowdy, he said you cannot assert the fifth and then present your side of the story.
Check my post #35
Ha ha..... :-)
Glad you liked it! Happens to me ALL the time ‘cause I like to goof the spelling and I forget sometimes that Apple doesn’t....
Things going well this side of the Rivah personally. Politics in IOW aren’t doing so hot...I’m sure you’ve read all the who-struck-john on a school board member and a supe and our local NAACP...sheesh. Meanwhile our taxes went up again...great.
Gunna chill for the rest of the summah then try to help Cooooch win...
Bring her in and question her anyway.
“You seem to be sweating. Is it too hot in here for you?”
“I assert my rights under the Fifth Amendment and refuse to answer that question.”
“How about deodorant? Does the Fifth Amendment preclude you from using deodorant?”
“Are you implying that I stink?”
“I assert my rights under the Fifth Amendment to not answer YOUR question! Now, how do you like that Ms Fifth Amendment smarty-pants? And I’m not implying anything. Your behavior in this matter stinks so bad that there isn’t enough SECRET deodorant in the country to cover up your stench.”
Apparently Ms. Lerner was too clever by half.
Hilarious, FRiend ;^)
Yep...he said it and FReepers repeated it, LOUDLY!!
Okay, Issa...now what?
Didn't a dem invoke "macarthy" during a roll call?
He did it in a very snarky way, IIRC. It was too cute by half, IIRC.
Yeah, I did hear about that... I hope it settles down over there.
Rep Gowdy can say all day long, but the witness will invoke and has a right to do so. it is incumbent on the state or congress in this case to introduce evidence to the contrary and pursue justice that way. or prove her statements are not true.
she can say all day long, “i did nothing wrong. i will not answer, that question on fifth amendment grounds.”
that is the reality of the situation.
giving her immunity to get to higher ups will end the search because she will be immune to prosecution and the one who instigated the scrutiny.
we need more evidence and then threaten prosecution.
even on circumstantial evidence. make her want to talk.
No, worse.. You cannot give your sound bite to the state run media then say you will not talk.
I think she knows she is free from harm regardless what happens. Holder is head of DOJ.. 0bama is his boss.. SCOTUS has been blackmailed to give 0bama his way.. We’re screwed every which way you look at it. Congress’ citing of Holder with ‘Contempt of Congress’ charge means nothing.
