Here's What Happens If You Don't Sign Up For Obamacare (Sorting out the confusion)

We're months away from cutting the ribbon on the new online marketplace for health insurance, but the vast majority of uninsured Americans — the very people the Affordable Care Act is meant to help — still have no idea whether they'll be in the shopping mood or not.

According to a recent survey, nearly two-thirds of uninsured Americans say they haven't decided whether or not they'll buy health insurance by the Jan. 1, 2014 deadline (even though they'll have to pay a penalty if they don't).

Another 10% say they flat out won't buy in at all.

We understand the hesitation. Change is hard enough when it's simple to understand, let alone when it has to do with things like insurance, health care policy, and your own financial and personal well-being.

"People just don't understand how this is going to affect their wallet, what prices are going to be and what this could really cost them," said Laura Adams, InsuranceQuotes.com senior insurance analyst.

Here's what you need to know:

1) What is this new health care exchange all about?

The health care exchange (aka The Marketplace) is the centerpiece of the Affordable Care Act, an online marketplace where consumers can shop around for health care plans, just like auto insurance. All 50 states will have their own marketplaces, some of which will be run by the federal government and some of which will be run by individual states.

Delays notwithstanding, the marketplace opens on Oct. 1, 2013 and people will have until Jan 1, 2014 to pick up a policy if they want to escape penalties. There, you'll be able to choose from four different varieties of plans, platinum (highest benefits), gold, silver, and bronze (lowest benefits).

In fact the laws states that the IRS can neither garnish your wages nor put a lien on you.

The Constitution states that the Executive Branch is supposed to enforce laws dutifully enacted by Congress - exactly how did that work for immigration? DOMA? International weapons sales? Oh, and the law states that it is a "fine" too, so how did that work out at SCOTUS?

Understand that no matter HOW this law is written, the law will be used like a gigantic, heavy-handed BULL WHIP across the backs of every American - words, meanings or intentions be DAMNED!

The IRS cannot write penalties only Congress can do that.

Legally, yes, at least for $$ penalties. But the IRS can write regulations that are so onerous as to amount to penalties. And it has infinite resources to harass and intimidate the average citizen. A bureaucrat at the IRS wants to destroy you, he will.

but the IRS doesn’t have the authority to re-write the law.

Legally no.

But it can and does write "regulations" that effectively do the same thing.

The House has voted to repal the law

So what? Symbolic. Without the Commie Senate, means nothing.
My wife said that if a hot 30 yo walked up to me out of the blue and begged me to have sex with her, I had permission. We both know that ain't gonna happen.

Yes, and not many people are willing to boycott healthcare. That's the real problem. Most people I know grumble about insurance, but they continue to have insurance because they aren't prepared to quit getting healthcare.

Adjust your W4 accordingly and you’ll never pay the fine.

One of the most useful pieces of advice my father gave me was to adjust your W4 so you break even, or owe them a little money. Why would you want to give the government an interest free loan for a whole year?

I was only able to pull it off for a little while. Early on I made too little, and kept getting money back. Then a few years back Mrs. MAExile started an on-line business, and my days of breaking even were over for good.

If I read it correctly, I will either live in a state that gives a subsidy, or else pay 42% of my income for it, tax breaks don’t apply to me.

Then what’s with the request by the IRS to hire 16,500 new IRS personnel to help enforce Obamacare?

This is from Investors Business Daily - “The embattled agency is asking Congress for additional funding to hire as many as 16,500 more agents, auditors and other workers to enforce and implement ObamaCare. Over the next decade, the nonpartisan Congressional Budget Office figures the IRS could need up to $10 billion to do the job.”

Also, FactCheck.Org (a site I hate because they are leftwing), cites the very issue you claim. They agree with what you say about the IRS not being permitted to issue liens against or bringing a “criminal” complaint against those who refuse to pay the penalty, but - FactCheck does say:

“The law specifically states on page 151 that the government cannot “file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or … levy on any such property with respect to such failure. - But as we noted, the law leaves room for the IRS to issue penalties and to sue to recover the unpaid tax, just as it does now for overdue taxes.
