Gessler’s office upholds recall petition language against Morse, Giron (Colorado)

It was two swings and two misses today for the lawyers fighting the recall campaigns against state Sen. Angela Giron, D-Pueblo, and state Sen. John Morse, D-Colorado Springs.

Deputy Secretary of State Suzanne Staiert handed down two rulings at 5 p.m that move the recall efforts forward: First, she denied a motion from attorney Mark Grueskin to have Secretary of State Scott Gessler and his office recuse itself from hearing the legal challenge against the recall petitions. Secondly, she upheld the wording of the petitions – a decision that wasn’t unexpected and is likely to send the recall fight into district court. Grueskin’s reaction was, “We’re going to court.”

Unless lawyers for either side ask for a court injunction against the state recall timetable, Gessler’s office will notify Gov. John Hickenlooper that a special election for Morse must be scheduled in no sooner than 45 days but no later than 75 days. A similar notification would be made for Giron after Tuesday, if her supporters cannot invalidate the recall petitions against her by whittling down the number of signatures from 12,648 to fewer than 11,285. The motion to have Gessler’s office recuse itself from the recall process was a last-minute tactic based on Gessler speaking to a group of Pueblo County Republicans last March 12. Asked about the recall process, he gave the GOP crowd candid answers about the challenge of recalling a state official. Grueskin argued those answers showed an appearance of bias against Giron. Staiert disagreed and handed down her ruling on the petition language as well. She said the petition wording met the legal requirements of a recall as well.

Staiert said the state recall laws should be interpreted liberally in favor of the public’s right to recall officials. No one expected Gessler’s office to set aside petition language that his staff had approved earlier this year. “We’re pleased with the decision. It’s what we expected,” said Victor Head, one of the recall organizers. “It’s unfortunate this will probably be drug out in court now.”

This points up the extreme importance of having conservatives elected as Secy of State in the individual states.

The hardcore Left made a major effort to get their people elected in the past couple of years. Even wrote a book about it. They largely failed but in Minnesota, years ago, they got a good leftist/documents friend of the Communist Party of Minnesota, Mark Ritchie, elected as SecyState.

Guess whose election challenges he handled. Norman Coleman versus Al Franken, decided by at most, a couple hundred votes, and where serious charges of voter fraud were aimed at the Democrats.

Guess who got elected as US Senator without a serious investigation into voter fraud. Yep, Al Franken.

Take all elected positions seriously and make sure that the hardcore Left doesn’t win the Secy of State position.

The CO SoS ruling below, and looks like and argument for court. I’ve read that the recalled rats will appeal in the Denver District Court looking for the usual corruption to end it.

If leftist extremists can't win, they lie and cheat. If lying and cheating don't work, they shop for corrupt judges. Speaking strictly as a Coloradan: they'll find one in Denver without too much trouble.
