Unarmed teen shot inside homeowner's fenced yard, but not breaking into home, NOPD warrant says

A 14-year-old boy remained in critical condition Friday after being shot in the head by a homeowner who said he thought the teen was trying to break into his house. But police said the teen was unarmed and did not pose an "imminent threat" when he was shot and have charged the owner with attempted second-degree murder.

The family of Marshall Coulter said the teenager could move only the right side of his body a little, but not the left. Doctors told the family that if Coulter survives, he would likely be severely brain damaged.

Coulter's family acknowledged the teen's history of burglary arrests but said he had never used a gun.

Police said that Coulter did not pose a threat to the homeowner, Merritt Landry, who works as a building inspector for the Historic District Landmarks Commission.

Look at the kid's past and look at the homeowner’s.If the kid's dirty and the homeowner’s clean then the most I'd convict him of is disturbing the peace.

and the neighbor didn’t call the cops when he saw these yoots casing the house because he didn’t want to profile a “black child” just out biking at 1AM

I’d say once someone jumps your fence they are an intruder, not a suspected intruder

If the homeowner called the cops, they’d probably show up, confiscate his gun, terrorize his family and shoot his dog

WHERE are his parents?????

IS there any black family in the USA that pays attention to where their kids are???

Even with a fairly good moon last night, IF I had an intruder at 2 AM, I would ONLY think that someone is up to no good. Trying to steal something—gas from my car—something out of the garage—one of the animals.

Not too many of us where I live count on calling 911 before we handle things ourselves. We are too far from the sheriff’s office.

First off, does a homeowner have a legitimate right to protect their property? The thief wasn’t breaking into the home. He was apparently breaking into the homeowner’s car. So, does a guy have a right to leave the safety of their home and confront a thief that’s outside? If the answer is yes, then it’s only reasonable to assume a thief is armed until proven otherwise.

If the article accurately depicted the facts of the case, then I don’t see how the homeowner could have known the thief was unarmed. Maybe the homeowner shot the thief in cold blood. That will need to be proven, and it misses the larger point. The THIEF is the one who initiated this entire, nasty chain of events, not the homeowner. Don’t steal and one is unlikely to get gunned down for stealing. I think that’s the key lesson.

Sounds like there’s surveillance video of the teen and another boy riding bicycles up and down the street looking at houses. Kid then jumps the home’s fence.Not to mention the teen is awaiting trial on another charge..

Hazouri, who owns property near Landry's house, said his surveillance cameras captured two juveniles riding BMX bikes up and down Mandeville and Dauphine streets around 1:44 a.m. One of the teens was wearing a blue tank top with white stripes; the other was wearing a light-colored T-shirt, Hazouri said.

Earlier in the evening, a different neighbor said the teen in the blue tank top had been biking around the area around 8 p.m. and the neighbor believed he was looking at different houses.

"I thought about calling the cops, but the last thing I want to do is racially profile a little kid who's just biking," said the neighbor, who spoke on condition of anonymity. The neighbor and Landry are white; the two teens are black.

Hazouri said his video, which he gave to NOPD detectives, shows the two teens talking in the middle of Mandeville Street outside of Landry's house. The video then shows the teen in the light-colored T-shirt walk his bike across Mandeville toward Landry's house. Then, the teen walks back out to the middle of the road before climbing over Landry's fence, Hazouri said. The other teen in the tank top stayed on the other side of Mandeville Street, Hazouri said.

Other teen stayed on other side of street, acting as lookout perhaps, for this 14 year old "professional thief" (as described by his brother)?

NH law covers the area inside your fence. In legalizes, it's called your "curtilage".

Does Louisiana law cover use of deadly force within your curtilage? I sure hope so, for this dude's sake.

I’m curious, does NO and/or LA have a “Stand Your Ground” or “Castle Doctrine” law? Seems the Castle Doctrine would cover the home owner when someone (with a known criminal history) gets on/into his back yard without his permission.

I hate the silent runners that are out biking at 2 am.

They creep me out.
I step out at 2 am to look at the moon and some 28 year old is coasting down the street looking about.

The dogs generally bark, but some ahole walked off with a gas can this week.
I personally would never shoot some one over property, but I certainly would be within my rights to do so in this state.

The punks know you wont shoot over $10
And they know you wont shoot over grand theft auto because you have insurance, so they will just hit you over and over bleeding you to death.

Mr Landry was completely within his rights, but now he will sit before a grand jury in a very unsympathetic political time.

A neighbors report:

The video has been given to police. A second unidentified neighbor claimed to have seen the boy in the blue striped shirt earlier in the evening at about 8 p.m. The neighbor believed he was looking at different houses.

"I thought about calling the cops, but the last thing I want to do is racially profile a little kid who's just biking," said the anonymous neighbor.

As per the neighbor's accounts, the kids were black.

Shot near the back door of a home at ~2AM after jumping a not-insubstantial fence. The “kid” wasn’t there by accident and at 2AM was up to no good. No bill from me.

NO great loss. His career as a professional thief is over in any case. I’d ask the little punk if whatever he was planning to steal is worth it now. If he hadn’t CHOSEN to climb someone’s fence at 2am to STEAL he wouldn’t have a bullet hole in his head. And considering his family and actions I’d say he was brain damaged BEFORE he was shot. NO GREAT LOSS.

I can answer this. I’d feel terrible. I’d feel sorry for my brother or sister, AND I would feel they had brought it on themselves. I would hold no ill will toward the homeowner as my brother or sister was the cause of the tragic chain of events, not the homeowner.

I did things when I was a teenager that I’m not proud of. Do I blame the people who caught and stopped me? No. My actions were entirely my own fault. I’m sorry for my sins and pray I never repeat any of them.
