Pantano asserts the court erred in finding no justifiable need, and, in the alternative, he argues the justifiable need requirement infringes his right to bear arms under the Second Amendment. U.S. Constitution, amendment. II. Although Concealed Carry Laws are on the books in New Jersey, judges and police chiefs have almost unanimously declined concealed carry permits to everyone but, other police, judges, politicians and famous friends of the aforementioned Effectively New Jersey does not have Concealed Carry, and contrary to mainstream media reports, is still the only state in the USA where its citizens can not defend themselves outside their homes. Supporters of concealed carry rights in NJ are looking forward to their day in Court even if it only leads to a further appeal to higher courts. Pantano is represent by Evan Nappen, better known as “NJ’s Gun Lawyer” as he literally wrote the book on New Jersey Gun Laws.

Do I have to demonstrate “justifiable need” to exercise my *First* Amendment rights? Or *Fifth*?

This is a crucial showdown. Either they go 5-4 in favor of continuing the union, or they go 5-4 to incite the Second American Revolution, IMO.

Can I stop paying my taxes until the government demonstrates a "justifiable need" for them?

Can I, huh, can I?

If people believe that the police are public friends as in the yesterday they need to make a redo on what has been changing. The police forces of today are just that i.e. forces of established government and unions. They are a quasi government that sets their own agenda with the help of sniveling local politicians. There are probably individual police types who would like to be of the old school but they too like the guaranteed income and perks without hassles. When was the last time you heard that the public except for sheriffs had a chance to pass on a police chief?

Imo, the supreme court in nj is part of the problem, and this is just another dog and pony show.

Why would they give a damn about other people having the right to carry?
Does anyone really believe that any judge in that court doesn't carry if they choose to?

They all use rights that they steal from others.

BANG!

FReepmail me if you want off of my New Jersey ping list. Does any one keep a New Jersey ping list besides me? Are there any volunteers for a copy of my list.

I'm from NYC. Somebody from New Jersey should have a list for stories like this, IMHO. Good luck with the appeal.

I won't get my hopes up.

This is the august body of Solomonic judgment that gave us the illegal Lautenberg II.

I live in the PRNJ, buy my guns from Bud’s and have them shipped to an FFL in the PRNJ. The FFL applied for a ccw permit because he has lots of guns on his premises but felt the need to actually bear one or two on him outside of the premises because his FFL job makes him a prime target. When his application got to the judge, he was turned down because he did not demonstrate sufficient need. I’d love to see this appealed all the way.

Yeah, and the IRS needs a clean bill of health, too. Tell 'em Judge Standing Wolf said so.

that’s about it. we cannot have government over us that will not adhere to its own laws and determines what laws it will allow and what laws it will block, even though they are on the books. they don’t get to play emperor if we have a constitutional republic.

and it has gotten way, way out of hand, we are frigging east germany spying on everyone, death by swat - wrong house or on purpose - and now we are told we are at war with al qaida, the taliban and ‘associated partners’ that we cannot know because that’s classified....?

and the republicans have their thumbs up their asses and are not screaming about any of this crap. this is impeachment and removal type stuff, to not have ANY HEAT at all from congress is sick and the repubs are in on it. the leadership is.

and obama just loves it because this is his main goal - to incite a civil war and to do it regardless of what it takes - racial issues, attempting to kill gun rights, or peoplefinally rising up against orwellian snoop tactics at every level of government. whatever it takes, to take down america and throw it into chaos.

when america can be taken down in chaos, that’s when the nwo will move fast to implement a whole host of events to cement in global power structures that can’t be taken down.

The mere requirement for any permit or registration in any state is an infringement on out second amendment rights, let alone having to prove a “need”.

“If people believe that the police are public friends as in the yesterday they need to make a redo on what has been changing. The police forces of today are just that i.e. forces of established government and unions.”

I think it is a mixed bag. In a lot of the big urban centers it may be so, but in a lot of “flyover” country, it is not so clear cut.

Unintended consequences will be the result of these machinations, IMO. They may believe they are steering events in directions they can control, but that which cannot be accounted for thus not factored into their equations will change the outcome to their detriment.

FYI — this is the New Jersey Supreme Court being talked about, not SCOTUS.

Thank you for pointing that out. At first I thought it was SCOTUS. In any case, if this goes against American citizens in NJ, it hopefully will be appealed to SCOTUS.

I hope the NJ Supreme Court rules correctly, but I doubt that will happen, so the next stop will be SCOTUS and a very important ruling, IMO.

No, the next stop would be the federal court for that district. You don’t jump from state court right to SCOTUS?

The next step after a decision from t he highest court in a state is the U.S. Supreme Court.
