Obama Administration Has Missed Half Of Obamacare's Legally Imposed Implementation Deadlines

In recent months, President Obama and his subordinates have waived or delayed a number of Obamacare’s notable features, such as the law’s employer mandate, and its procedures for protecting taxpayers from fraud and identity theft. Earlier this month, in that context, I obtained a heretofore-unpublished memorandum from the Congressional Research Service. The CRS, Congress’ non-partisan in-house think tank, compiled 82 deadlines that the Affordable Care Act mandates upon the first three years of its own implementation. Remarkably, it turns out that the White House has missed half of the deadlines legally required by the ACA. And some of those deadlines remain unmet to this day.

As of May 31, 2013, when the CRS analysis was completed, the White House had yet to meet 9 of 12 deadlines from the first year after the Affordable Care Act was enacted. It failed to meet 22 of 53 deadlines in the second year; another 8 became moot after Congress did not appropriate funds to complete the assigned tasks. In year three, the administration missed 10 out of 17 deadlines. That’s a total of 41 out of 82 deadlines missed.

If you exclude the 9 deadlines that became moot because Congress never appropriated the funds to meet them, the Obama administration missed 41 out of 73 deadlines, or 56 percent.

This morning the newsies are running a clip of Obama blaming the Republicans for all the problems and delays with — Obamacare.

So what if not one Republican voted for that monstrosity.

So what if Pelosi had to get it passed before she could even read it to find out what was in it.

So what if Obama has been delaying parts of Obamacare unilaterally, and possibly illegally, without Congressional approval.

Response from the GOP leadership: {crickets chirping}

By the end of the day the LIV will ‘know’ that the Republicans are to blame for all the Obamacare ills — and higher premiums, etc.

Not to worry, Rove and the other Elites and advisors still get their paychecks.

Not to worry, Congress gets its exemption from Obamacare.

Obama's approval numbers are now hitting record lows, yet his critics are often written off as simple- minded "Obama haters." It doesn't wash. The problem is a pattern of presidential lawlessness.

Last time we checked, the Constitution requires the president to "faithfully execute the law." That's no editorial opinion, but Article 2, Section 3, Clause 5 of the U.S. Constitution, which states that "(The President) shall take care that the Laws be faithfully executed."

Our founders conceived and established in that document three co-equal branches of government to preserve our individual liberty and restrain the unlimited power of government.

But this president and his administration have routinely ignored the divisions of power between the presidency, the Congress and its legislation, and the Supreme Court and its rulings. Constitutionally, the president has the authority to check the legislative branch by recommending legislation to be passed by Congress or through the presidential veto.

But he cannot legislate through executive fiat and he can't pick and choose which parts of the law he will comply with or decline. Nor can he defy judicial rulings from the highest court in the land. But that's what he's done. In just the latest example, President Obama's Attorney General Eric Holder has directed federal prosecutors to conceal the amount of drugs seized during an arrest to circumvent mandatory minimum sentences set by Congress in 1986.

Whether one agrees with that law or not, its legal authority lies within the constitutional powers of Congress, not the executive branch. And that's the issue. It's part of a growing litany of presidential lawlessness:

OKLAHOMA WINS FIRST OCARE BATTLE: AG Pruitt--- "Obamacare was meant to be so open-ended that it could mean anything. We are seeing thousands of pages of new rules being written, both by HHS and the IRS. The open-ended interpretation of Obamacare enables this.....if the law doesn't contain a particular provision, no problem. They just make it up as they go along."

Such is the case that involves the OK lawsuit.

“The court rejected the federal government’s argument that Oklahoma lacked standing to challenge the law, allowing us to proceed with this pivotal case,” “We’re optimistic the court will recognize what states have known for months that the IRS disregarded the law by making the large employer mandate effective in Oklahoma or in any of the 33 other states without a state health care exchange.”

REFERENCE Oklahoma challenged implementation of the Affordable Care Act after the IRS finalized a rule that would allow the federal government to punish “large employers,” including local government, with millions of dollars in tax penalties in states without state health care exchanges, which is not allowed under the health care law.

“Congress provided a choice for Oklahoma and other states in implementation of the health care law, and the IRS is attempting to take that away by rule,” General Pruitt said. “The administration miscalculated how many states would support this law, so now they’re using the IRS to push through provisions that Congress did not pass.”

ACTION NOW We need to get the OK lawsuit going in every state. Contact the PTB in your state. Judging from the legal language AG Pruitt used, I would also conclude that Obamacare might be ripe for a RICO action.

Here we have the POTUS directly blaming the GOP. Last week the GOP leadership sent a strongly worded letter to an assistant cabinet secretary. Who do you think will win this debate?

As long as the Surrender Party refuses to engage the kenyan they will LOSE. The only possible explanation is they do not want to win and are happy to let obama do the heavy lifting installing statist apparatus.
